SYNOPSIS AS INTRODUCED:
 
110 ILCS 205/8  from Ch. 144, par. 188

    Amends the Board of Higher Education Act. With respect to the Board's analysis of formulating the annual budget request for State universities and colleges, provides that, beginning with Fiscal Year 2013, the annual budget request must incorporate performance-based funding, pursuant to the report of the Board's Higher Education Finance Study Commission. Provides that the Board shall have 2 fiscal years to implement this performance-based funding, and thereafter must update how this funding is calculated every 6 months, which updates must be reported to the Governor and the General Assembly. Effective immediately.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Board of Higher Education Act is amended by
5changing Section 8 as follows:
 
6    (110 ILCS 205/8)  (from Ch. 144, par. 188)
7    Sec. 8. The Board of Trustees of the University of
8Illinois, the Board of Trustees of Southern Illinois
9University, the Board of Trustees of Chicago State University,
10the Board of Trustees of Eastern Illinois University, the Board
11of Trustees of Governors State University, the Board of
12Trustees of Illinois State University, the Board of Trustees of
13Northeastern Illinois University, the Board of Trustees of
14Northern Illinois University, the Board of Trustees of Western
15Illinois University, and the Illinois Community College Board
16shall submit to the Board not later than the 15th day of
17November of each year its budget proposals for the operation
18and capital needs of the institutions under its governance or
19supervision for the ensuing fiscal year. Each budget proposal
20shall conform to the procedures developed by the Board in the
21design of an information system for State universities and
22colleges.
23    In order to maintain a cohesive system of higher education,

1the Board and its staff shall communicate on a regular basis
2with all public university presidents. They shall meet at least
3semiannually to achieve economies of scale where possible and
4provide the most innovative and efficient programs and
5services.
6    The Board, in the analysis of formulating the annual budget
7request, shall consider rates of tuition and fees at the state
8universities and colleges. The Board shall also consider the
9current and projected utilization of the total physical plant
10of each campus of a university or college in approving the
11capital budget for any new building or facility. However,
12beginning with Fiscal Year 2013, the annual budget request must
13incorporate performance-based funding, pursuant to the report
14of the Board's Higher Education Finance Study Commission. The
15Board shall have 2 fiscal years to implement this
16performance-based funding, and thereafter must update how this
17funding is calculated every 6 months, which updates must be
18reported to the Governor and the General Assembly.
19    The Board of Higher Education shall submit to the Governor,
20to the General Assembly, and to the appropriate budget agencies
21of the Governor and General Assembly its analysis and
22recommendations on such budget proposals.
23    Each state supported institution within the application of
24this Act must submit its plan for capital improvements of
25non-instructional facilities to the Board for approval before
26final commitments are made. Non-instructional uses shall

1include but not be limited to dormitories, union buildings,
2field houses, stadium, other recreational facilities and
3parking lots. The Board shall determine whether or not any
4project submitted for approval is consistent with the master
5plan for higher education and with instructional buildings that
6are provided for therein. If the project is found by a majority
7of the Board not to be consistent, such capital improvement
8shall not be constructed.

10    Section 99. Effective date. This Act takes effect upon
11becoming law.
