AMENDMENT TO HOUSE BILL 5650

2    AMENDMENT NO. ______. Amend House Bill 5650 by replacing
3everything after the enacting clause with the following:
 
4    "Section 1. Short title. This Act may be cited as the State
5Vehicle Use Act.
 
6    Section 5. Definitions. As used in this Act:
7    "Constitutional officers" means the officers created under
8Article V of the Illinois Constitution.
9    "Department" means the Department of Central Management
10Services.
11    "Division of Vehicles" means the Division of Vehicles
12within the Department of Central Management Services.
13    "State agency" means all departments, officers,
14commissions, boards, institutions, and bodies politic and
15corporate of the State. "State agency" does not include the
16judicial branch, including, without limitation, the several

1courts of the State, the offices of the clerk of the supreme
2court and the clerks of the appellate court, and the
3Administrative Office of the Illinois Courts, the legislature
4or its committees or commissions, or units of local government.
5    "Vehicle" means any motor vehicle belonging to the State of
6Illinois or any agency, board, commission, branch, or
7department thereof or controlled thereby, including
8automobiles, motorcycles, trucks, and other types of
9automotive equipment.
 
10    Section 10. Vehicle use officer; vehicle use policy.
11    (a) Each State agency shall designate a vehicle use officer
12to monitor the use of State-owned vehicles by that State
13agency.
14    (b) Each State agency, with the assistance of the vehicle
15use officer, shall draft a vehicle use policy. All vehicle use
16policies, other than those drafted by a constitutional officer,
17shall be submitted to the Division of Vehicles within the
18Department of Central Management Services and shall be made
19publicly available on the Department's official Internet
20website. A vehicle use officer for a constitutional officer
21shall make the vehicle use policy publicly available on the
22constitutional officer's official Internet website. A vehicle
23use policy shall include the following:
24        (1) a policy concerning take-home vehicles, including
25    requirements for emergency use of take-home vehicles and

1    restrictions on the use of take-home vehicles solely for
2    commuting; and
3        (2) procedures regarding daily vehicle use logs and
4    mileage recording.
 
5    Section 20. Mileage reimbursement. For cases in which a
6State employee would otherwise use a State-owned vehicle but
7uses his or her own vehicle instead, a State agency may
8reimburse a State employee for automobile travel expenses in
9accordance with the State Travel Regulations and Reimbursement
10Rates adopted under Section 12-2 of the State Finance Act.
 
11    Section 25. The Department of Central Management Services
12Law of the Civil Administrative Code of Illinois is amended by
13changing Section 405-280 as follows:
 
14    (20 ILCS 405/405-280)  (was 20 ILCS 405/67.15)
15    Sec. 405-280. State garages; passenger cars.
16    (a) To supervise and administer all State garages used for
17the repair, maintenance, or servicing of State-owned motor
18vehicles except those operated by any State college or
19university or by the Illinois Mathematics and Science Academy;
20and to acquire, maintain, and administer the operation of the
21passenger cars reasonably necessary to the operations of the
22executive department of the State government. To this end, the
23Department shall adopt regulations setting forth guidelines

1for the acquisition, use, maintenance, and replacement of motor
2vehicles, including the use of ethanol blended gasoline
3whenever feasible, used by the executive department of State
4government; shall occupy the space and take possession of the
5personnel, facilities, equipment, tools, and vehicles that are
6in the possession or under the administration of the former
7Department of Administrative Services for these purposes on
8July 13, 1982 (the effective date of Public Act 82-789); and
9shall, from time to time, acquire any further, additional, and
10replacement facilities, space, tools, and vehicles that are
11reasonably necessary for the purposes described in this
12Section.
13    (b) The Department shall evaluate the availability and cost
14of GPS systems that State agencies may be able to use to track
15State-owned motor vehicles.
16    (c) The Department shall distribute a spreadsheet or
17otherwise make data entry available to each State agency to
18facilitate the collection of data for publishing on the
19Department's Internet website. Each State agency shall
20cooperate with the Department in furnishing the data necessary
21for the implementation of this subsection within the timeframe
22specified by the Department. Each State agency shall be
23responsible for the validity and accuracy of the data provided.
24Beginning on July 1, 2013, the Department shall make available
25to the public on its Internet website the following
26information:

1        (1) vehicle cost data, organized by individual vehicle
2    and by State agency, and including repair, maintenance,
3    fuel, insurance, and other costs, as well as whether
4    required vehicle inspections have been performed; and
5        (2) an annual vehicle breakeven analysis, organized by
6    individual vehicle and by State agency, comparing the
7    number of miles a vehicle has been driven with the total
8    cost of maintaining the vehicle.
9    (d) Beginning on the effective date of this amendatory Act
10of the 97th General Assembly, and notwithstanding any provision
11of law to the contrary, the Department may not make any new
12motor vehicle purchases until the Department sets forth
13procedures to condition the purchase of new motor vehicles on
14(i) a determination of need based on a breakeven analysis, and
15(ii) a determination that no other available means, including
16car sharing or rental agreements, would be more cost-effective
17to the State. However, the Department may purchase motor
18vehicles not meeting or exceeding a breakeven analysis only if
19there is no alternative available to carry out agency work
20functions and the purchase is approved by the Manager of the
21Division of Vehicles upon the receipt of a written explanation
22from the agency head of the operational needs justifying the
23purchase.
