AMENDMENT TO SENATE BILL 1653

AMENDMENT NO. ______. Amend Senate Bill 1653, AS AMENDED, with reference to page and line numbers of House Amendment No. 1 as follows:

on page 10, immediately below line 8, by inserting the following:

""Service area" has the same definition as found in Section 16-102 of the Public Utilities Act."; and

by replacing line 20 on page 18 through line 2 on page 19 with with the following: "then they shall be procured in states that adjoin Illinois. If resources are not available in Illinois or in states that adjoin Illinois, then they may be purchased elsewhere. Beginning June 1, 2011, resources procured pursuant to this Section shall be procured from facilities located in Illinois or states that adjoin Illinois. If resources are not available in Illinois or in states that adjoin Illinois, then they may be procured elsewhere. To the extent available, at least 75% of"; and

on page 32, line 1, after "of", by inserting "cost-effective"; and

on page 34, by replacing lines 1 through 7 with "review and approval."; and

on page 36, by replacing lines 16 through 21 with the following:

"For periods beginning on or after June 1,"; and

on page 140, line 14, after "facilities.", by inserting "Beginning June 1, 2012, charges for delivery services shall also include the recovery of the electric utility's costs of renewable energy credits and excluded renewable energy resources contract costs in accordance with subsection (k) of this Section."; and

on page 151, line 3, after "tariff", by inserting "and approved by the Commission in connection with its approval of the tariff"; and

on page 174, line 7, immediately after "Act", by inserting ", and any excluded renewable energy resources contract costs as defined in Section 1-10 of the Illinois Power Agency Act,"; and

on page 198, lines 19 and 25, by replacing "alternative electric suppliers" each time it appears with "alternative retail electric suppliers".
