AMENDMENT TO HOUSE BILL 1142

2    AMENDMENT NO. ______. Amend House Bill 1142 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Counties Code is amended by adding Section
55-1134 as follows:
 
6    (55 ILCS 5/5-1134 new)
7    Sec. 5-1134. Unwanted firearms. The county board of each
8county, in consultation with the sheriff, shall establish a
9program allowing individuals to turn in unwanted firearms by
10calling the sheriff's office to set up a time to turn the
11firearms in at the sheriff's office.
12    This Section is a limitation of home rule powers and
13functions under subsection (i) of Section 6 of Article VII of
14the Illinois Constitution on the concurrent exercise by home
15rule units of powers and functions exercised by the State.

1    Section 10. The Illinois Municipal Code is amended by
2adding Section 11-1-12 as follows:
 
3    (65 ILCS 5/11-1-12 new)
4    Sec. 11-1-12. Unwanted firearms. The corporate authorities
5of any municipality that operates a police department shall
6establish a program allowing individuals to turn in unwanted
7firearms by calling that police department to set up a time to
8turn the firearms in at a police station.
9    This Section is a limitation of home rule powers and
10functions under subsection (i) of Section 6 of Article VII of
11the Illinois Constitution on the concurrent exercise by home
12rule units of powers and functions exercised by the State.
 
13    Section 15. The Local Governmental and Governmental
14Employees Tort Immunity Act is amended by adding Section 4-108
15as follows:
 
16    (745 ILCS 10/4-108 new)
17    Sec. 4-108. Neither a local public entity nor a public
18employee acting within the scope of his or her employment is
19liable for any injury or loss caused by actions taken to create
20or conduct a program established under Section 5-1134 of the
21Counties Code or Section 11-1-12 of the Illinois Municipal
22Code.

1    Section 90. The State Mandates Act is amended by adding
2Section 8.37 as follows:
 
3    (30 ILCS 805/8.37 new)
4    Sec. 8.37. Exempt mandate. Notwithstanding Sections 6 and 8
5of this Act, no reimbursement by the State is required for the
6implementation of any mandate created by this amendatory Act of
7the 98th General Assembly.".
