SYNOPSIS AS INTRODUCED:
 
815 ILCS 505/2QQQ new

    Amends the Consumer Fraud and Deceptive Business Practices Act. Provides that it is an unlawful practice for a person to impose a surcharge upon a consumer who elects to pay by use of a credit card instead of making payment by cash, check, or similar means of payment. Effective immediately.

1    AN ACT concerning business transactions.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Consumer Fraud and Deceptive Business
5Practices Act is amended by adding Section 2QQQ as follows:
 
6    (815 ILCS 505/2QQQ new)
7    Sec. 2QQQ. Credit card surcharges prohibited.
8    (a) No person in any sales transaction may impose a
9surcharge upon a consumer who elects to pay by use of a credit
10card instead of making payment by cash, check, or similar means
11of payment.
12    (b) A violation of this Section constitutes an unlawful
13practice within the meaning of this Act.
 
14    Section 99. Effective date. This Act takes effect upon
15becoming law.
