AMENDMENT TO HOUSE BILL 3260

2    AMENDMENT NO. ______. Amend House Bill 3260 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Department of Central Management Services
5Law of the Civil Administrative Code of Illinois is amended by
6adding Section 405-282 as follows:
 
7    (20 ILCS 405/405-282 new)
8    Sec. 405-282. Surplus vehicles. Notwithstanding any other
9provision of law to the contrary, all State-owned vehicles that
10were reported in the Performance Audit of the State Vehicles
11Fleet released by the Office of the Auditor General in November
122011 to have been driven 7,000 miles or less in Fiscal Year
132010 are deemed surplus and shall be sold using a competitive
14sealed bid method of sale on or before January 1, 2014. The
157,000 mile requirement set forth in this Section includes all
16miles driven including all miles driven while on official State

1business and all miles driven while not on official State
2business. This Section does not apply to vehicles driven by
3police or law enforcement personnel while on duty, or to
4emergency vehicles, snow plows, or heavy equipment vehicles.
5Proceeds from the sale of vehicles as provided in this Section
6shall be deposited into the State Garage Revolving Fund.
7Exceptions to this Section can be granted for vehicles
8identified in the Performance Audit of the State Vehicles Fleet
9released by the Office of the Auditor General in November 2011
10to have been driven 7,000 miles or less in Fiscal Year 2010, if
11those vehicles can be shown to have been driven 15,000 miles
12additional miles after the date of the audit and before the end
13of Fiscal Year 2012.
 
14    Section 99. Effective date. This Act takes effect upon
15becoming law.".
