AMENDMENT TO HOUSE BILL 3357

2    AMENDMENT NO. ______. Amend House Bill 3357 by replacing
3everything after the enacting clause with the following:
 
4    "Section 1. Short title. This Act may be cited as the
5Vulnerable Adults Abandonment Prevention Task Force Act.
 
6    Section 5. Vulnerable Adults Abandonment Prevention Task
7Force Act; members.
8    (a) There is created the Vulnerable Adults Abandonment
9Prevention Task Force (hereinafter referred to as the Task
10Force) to address the growing problem of vulnerable adults
11being left without regard for their mental or physical health,
12safety, or welfare. The Task Force shall consist of 12 members
13appointed as follows:
14        (1) 3 members of the Senate appointed by the President
15    of the Senate;
16        (2) 2 members of the Senate appointed by the Minority

1    Leader of the Senate;
2        (3) 3 members of the House of Representatives appointed
3    by the Speaker of the House of Representatives;
4        (4) 2 members of the House of Representatives appointed
5    by the Minority Leader of the House of Representatives; and
6        (5) 2 members appointed by the Governor one of whom
7    shall be designated the chairperson by the Governor.
8    (b) The members of the Task Force shall serve without
9compensation but shall be reimbursed for their reasonable and
10necessary expenses from funds appropriated for that purpose.
11    (c) The Task Force shall receive the assistance from the
12State of Illinois Council on Developmental Disabilities and
13shall seek input from the Department of Human Services, the
14Department on Aging, and the Office of State Guardian. The Task
15Force shall consult with representatives of law enforcement,
16bar associations, and not-for-profits focused on persons with
17developmental disabilities, mental illness, and victims of
18elder abuse in the preparation of its final report.
19    (d) The Task Force shall conduct a study on the incidence
20of abandonment of vulnerable adults by persons and entities
21legally responsible to safeguard the mental or physical health,
22safety, or welfare of persons who are severely or profoundly
23intellectually disabled as a result of developmental
24disabilities, mental illness, dementia, or other similar
25incapacity and to make recommendations sufficient to protect
26these vulnerable adults, including the consideration of

1criminal penalties for the abandonment of these vulnerable
2adults without assuring adequate support or supervision.
3    (e) On or before January 1, 2014, the Task Force shall
4report its findings and recommendations to the General
5Assembly, by filing copies of its report as provided in Section
63.1 of the General Assembly Organization Act, and to the
7Governor.
8    (f) The Task Force is abolished on May 31, 2014.
 
9    Section 10. Repeal. This Act is repealed on June 1, 2014.
 
10    Section 99. Effective date. This Act takes effect upon
11becoming law.".
