AMENDMENT TO HOUSE BILL 5082

2    AMENDMENT NO. ______. Amend House Bill 5082 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Fish and Aquatic Life Code is amended by
5changing Section 10-45 and by adding Section 10-47 as follows:
 
6    (515 ILCS 5/10-45)  (from Ch. 56, par. 10-45)
7    Sec. 10-45. Taking of bait fishes shad. All casting nets
8shall not be (1) larger than 24 8 feet in diameter or (2) of a
9mesh larger than 1 3/8 inch bar measurement. All shad scoops
10shall not be (1) larger than 30 inches in diameter, (2) of a
11mesh not larger than 1/2 inch bar measurement, or (3) longer
12than 4 feet in length. All individuals using either of these
13devices shall possess a valid sport fishing license.

1    Sec. 10-47. Taking of fish by casting net or shad scoop for
2use as bait. The following fish species may be taken with a
3casting net or shad scoop and used for bait on the body of
4water where they are collected if they are killed immediately:
5bighead carp (Hypophthalmichthys nobilis), black carp
6(Mylopharyngodon piceus), grass carp (Ctenopharyngodon
7idella), and silver carp (Hypophthalmichthys molotrix). The
8following fish species may be taken with a casting net or shad
9scoop and used for live or dead bait on the body of water where
10they are collected: mooneye (Hiodon tergisus), goldeye (Hiodon
11alosoides), skipjack herring (Alosa chrysochloris), carp
12(other than bighead carp (Hypophthalmichthys nobilis), black
13carp (Mylopharyngodon piceus), grass carp (Ctenopharyngodon
14idella), and silver carp (Hypophthalmichthys molotrix)), and
15any other fish listed in Section 10-110 of this Code. Any
16person using casting nets or a shad scoop for the taking of
17fish under this Section must possess a valid sport fishing
18license.".
