AMENDMENT TO SENATE BILL 496

2    AMENDMENT NO. ______. Amend Senate Bill 496 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Township Code is amended by adding Section
5170-65 as follows:
 
6    (60 ILCS 1/170-65 new)
7    Sec. 170-65. Dissolution of the Wood River Township
8Hospital.
9    (a) Dissolution.
10        (1) The Wood River Township Hospital is dissolved 180
11    days after the effective date of this amendatory Act of the
12    98th General Assembly.
13        (2) In the 180-day period prior to dissolution, the
14    hospital board shall be vested with the powers to wrap up
15    the affairs of the closed hospital under subsection (b) of
16    this Section, and to transfer any remaining hospital funds

1    under subsection (c) of this Section.
2    (b) Wrapping up the affairs of the Wood River Township
3Hospital.
4        (1) Within the first 10 business days of the 180-day
5    period provided in paragraph (2) of subsection (a) of this
6    Section, the chairman of the hospital board shall cause an
7    audit of all claims against the Wood River Township
8    Hospital, all receipts of the Wood River Township Hospital,
9    the inventory of all real and personal property owned by
10    the Wood River Township Hospital or under its control or
11    management, and any debts owed by the Wood River Township
12    Hospital. The chairman may, at his or her discretion,
13    undertake any other audit of the Wood River Township
14    Hospital. The person or entity conducting such audit shall
15    report the findings of the audit to the hospital board
16    within 30 days.
17        (2) Following the return of the audit provided in
18    paragraph (1) of this subsection, the hospital board shall:
19            (i) Pay the debts, obligations, and liabilities of
20        the Wood River Township Hospital that are outstanding
21        upon completion of the audit in paragraph (1) of this
22        subsection and all necessary expenses of closing up the
23        affairs of the Wood River Township Hospital.
24            (ii) Enter into an agreement with a hospital within
25        Madison County to ensure all patient records are
26        properly transferred. If no hospital in Madison County

1        is able or willing to accept the records, the records
2        may be transferred to a hospital within a neighboring
3        county contiguous to Madison County. The Wood River
4        Township Hospital will be responsible for paying a
5        reasonable service fee to the hospital that accepts and
6        retains records pursuant to this subsection. Following
7        successful transfer of the patient records, the
8        receiving hospital shall retain and destroy the
9        transferred patient records in accordance with the
10        receiving hospital's record retention schedule and
11        policies.
12            (iii) Sell the property of the Wood River Township
13        Hospital if any excess remains after all the
14        liabilities of the Wood River Township Hospital are
15        paid.
16    (c) Transfer of surplus funds. If any funds are available,
17the hospital board shall transfer, no later than 10 business
18days prior to the conclusion of the 180-day period provided in
19subsection (a) of this Section, all surplus funds, if any, to
20the Madison County Treasurer to be maintained in the Wood River
21Township Hospital Fund and be disposed of pursuant to
22subsection (d) of this Section.
23    If any liabilities remain, the funds available shall be set
24apart by the Madison County Treasurer and held for the purpose
25of retiring such liabilities.
26    (d) Payment of remaining liabilities and disposal of

1surplus funds. The Madison County Clerk shall pay any remaining
2liabilities of the Wood River Township Hospital from the Wood
3River Township Hospital Fund. After all the liabilities of the
4Wood River Township Hospital are paid, the Madison County Clerk
5shall distribute any funds remaining in the Wood River Township
6Hospital Fund to the property owners in Wood River Township as
7of the date of dissolution of Wood River Township Hospital. The
8distribution shall be proportional to the assessed value of the
9property in the 2005 levy year.
10    (e) Outstanding indebtedness.
11        (1) In the event that the Wood River Township Hospital
12    has notes outstanding which are a lien on funds available
13    in the Wood River Township Hospital Fund at the time of
14    dissolution, such lien shall be unimpaired by such
15    dissolution and the lien shall continue in favor of the
16    note holders.
17        (2) In the event that the Wood River Township Hospital
18    has unsecured debts outstanding at the time of dissolution,
19    any funds in the Wood River Township Hospital Fund or
20    otherwise available and not committed shall, to the extent
21    necessary, be applied to the payment of such debts.
22        (3) Madison County may levy a tax, on behalf of the
23    Wood River Township Hospital, upon all taxable real
24    property located in Wood River Township for the purpose of
25    paying the outstanding debts and obligations of the Wood
26    River Township Hospital.

1    (f) Tax collection and enforcement. The dissolution of the
2Wood River Township Hospital shall not adversely affect
3proceedings for the collection or enforcement of any tax. Those
4proceedings shall continue to finality as though no dissolution
5had taken place. The proceeds thereof shall be paid over to the
6Madison County Treasurer to be transferred pursuant to
7subsection (c) of this Section. Proceedings to collect and
8enforce such taxes may be instituted and carried on in the name
9of the Wood River Township Hospital.
10    (g) Litigation. All suits pending in any court on behalf of
11or against the Wood River Township Hospital may be prosecuted
12or defended in the name of Madison County by the State's
13attorney. All judgments obtained for the Wood River Township
14Hospital shall be collected and enforced by Madison County and
15transferred and disposed of pursuant to subsections (c) and (d)
16of this Section respectively.
 
17    Section 99. Effective date. This Act takes effect upon
18becoming law.".
