AMENDMENT TO SENATE BILL 2178

2    AMENDMENT NO. ______. Amend Senate Bill 2178, AS AMENDED,
3by replacing everything after the enacting clause with the
4following:
 
5    "Section 5. The School Code is amended by changing Section
622-15 as follows:
 
7    (105 ILCS 5/22-15)  (from Ch. 122, par. 22-15)
8    Sec. 22-15. Insurance on athletes.
9    (a) In this Section, "IHSA" means the Illinois High School
10Association.
11    (b) A public school district maintaining grades 9 through
1212 shall provide catastrophic accident insurance coverage,
13with aggregate benefit limits of $3 million or 5 years,
14whichever occurs first, for eligible students in grades 9
15through 12 who sustain an accidental injury while participating
16in school-sponsored or school-supervised interscholastic

1athletic events sanctioned by the IHSA (including direct and
2uninterrupted travel to and from the athletic event as well as
3during a temporary stay at the location of an athletic event
4held away from the student's school) that results in medical
5expenses in excess of $50,000. These benefit limits are to be
6in excess of any and all other insurance, coverage or benefit,
7in whatever form or designation. Any public school that
8requires students participating in school-sponsored or
9school-supervised interscholastic athletic events sanctioned
10by the IHSA (including direct and uninterrupted travel to and
11from the athletic event as well as during a temporary stay at
12the location of an athletic event held away from the student's
13school) to have personal accident and health insurance is
14exempt from the requirements of this Section.
15    Non-public schools maintaining grades 9 through 12 shall
16provide catastrophic accident insurance coverage, with
17aggregate benefit limits of $3 million or 5 years, whichever
18occurs first, for eligible students in grades 9 through 12 who
19sustain an accidental injury while participating in
20school-sponsored or school-supervised interscholastic athletic
21tournaments sanctioned by the IHSA (including direct and
22uninterrupted travel to and from the athletic tournament as
23well as during a temporary stay at the location of an athletic
24tournament held away from the student's school) that results in
25medical expenses in excess of $50,000. These benefit limits are
26to be in excess of any and all other insurance, coverage or

1benefit, in whatever form or designation. Any non-public school
2that requires students participating in school-sponsored or
3school-supervised interscholastic athletic events sanctioned
4by the IHSA (including direct and uninterrupted travel to and
5from the athletic event as well as during a temporary stay at
6the location of an athletic event held away from the student's
7school) to have personal accident and health insurance is
8exempt from the requirements of this Section.
9    (c) The IHSA has the exclusive authority to promulgate a
10plan of coverage necessary to ensure compliance with this
11Section. The IHSA shall provide a group policy providing the
12coverage necessary to comply with this Section. Public school
13districts and non-public schools may purchase the coverage
14necessary to comply with this Section by participating in the
15group policy.
16    Alternatively, public school districts or non-public
17schools that do not participate in the group policy may obtain
18the coverage necessary to comply with this Section from other
19coverage providers, but must submit to the IHSA, 60 days before
20the coverage inception, a certificate of insurance from the
21coverage provider stating that the insurance provided by the
22coverage provider is in compliance with the plan of coverage
23approved by the IHSA. A public school district that manages
24schools located within a city of over 500,000 inhabitants may
25provide the catastrophic accident insurance coverage required
26by this Section through a program of self-insurance, and the

1public school district must submit to the IHSA, 60 days before
2coverage inception, proof that the program is in compliance
3with the plan of coverage.
4    (d) A public school district maintaining grades
5kindergarten through 8 may The school board of any school
6district may, in its discretion, provide medical or hospital
7service, or both, through accident and health insurance on a
8group or individual basis, or through non-profit hospital
9service corporations or medical service plan corporations or
10both, for pupils of the district in grades kindergarten through
118 injured while participating in any athletic activity under
12the jurisdiction of or sponsored or controlled by the district
13or the authorities of any school thereof. The cost of such
14insurance or of subscriptions to such non-profit corporations,
15when paid from the funds of the district, shall, to the extent
16such moneys are sufficient, be paid from moneys derived from
17athletic activities. To the extent that moneys derived from
18athletic activities are insufficient, such cost may be paid
19from the educational fund of the district. Such insurance may
20be purchased from or such subscriptions may be taken in only
21such companies or corporations as are authorized to do business
22in Illinois.

24    Section 99. Effective date. This Act takes effect July 1,
252013.".
