    Amends the Illinois Vehicle Code. Provides that antique vehicles and expanded-use antique vehicles are required to display registration plates on the rear of the vehicle only. Provides that expanded-use antique vehicles may be operated year round with no restriction on destination or purpose.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Vehicle Code is amended by changing
5Sections 3-413 and 3-804.01 as follows:
 
6    (625 ILCS 5/3-413)  (from Ch. 95 1/2, par. 3-413)
7    Sec. 3-413. Display of registration plates, registration
8stickers, and drive-away permits; registration plate covers.
9    (a) Registration plates issued for a motor vehicle other
10than an antique vehicle, expanded-use antique vehicle, a
11motorcycle, trailer, semitrailer, truck-tractor, apportioned
12bus, or apportioned truck shall be attached thereto, one in the
13front and one in the rear. The registration plate issued for an
14antique vehicle, expanded-use antique vehicle, a motorcycle,
15trailer or semitrailer required to be registered hereunder and
16any apportionment plate issued to a bus under the provisions of
17this Code shall be attached to the rear thereof. The
18registration plate issued for a truck-tractor or an apportioned
19truck required to be registered hereunder shall be attached to
20the front thereof.
21    (b) Every registration plate shall at all times be securely
22fastened in a horizontal position to the vehicle for which it
23is issued so as to prevent the plate from swinging and at a

1height of not less than 5 inches from the ground, measuring
2from the bottom of such plate, in a place and position to be
3clearly visible and shall be maintained in a condition to be
4clearly legible, free from any materials that would obstruct
5the visibility of the plate. A registration plate on a
6motorcycle may be mounted vertically as long as it is otherwise
7clearly visible. Registration stickers issued as evidence of
8renewed annual registration shall be attached to registration
9plates as required by the Secretary of State, and be clearly
10visible at all times.
11    (c) Every drive-away permit issued pursuant to this Code
12shall be firmly attached to the motor vehicle in the manner
13prescribed by the Secretary of State. If a drive-away permit is
14affixed to a motor vehicle in any other manner the permit shall
15be void and of no effect.
16    (d) The Illinois prorate decal issued to a foreign
17registered vehicle part of a fleet prorated or apportioned with
18Illinois, shall be displayed on a registration plate and
19displayed on the front of such vehicle in the same manner as an
20Illinois registration plate.
21    (e) The registration plate issued for a camper body mounted
22on a truck displaying registration plates shall be attached to
23the rear of the camper body.
24    (f) No person shall operate a vehicle, nor permit the
25operation of a vehicle, upon which is displayed an Illinois
26registration plate, plates or registration stickers after the

1termination of the registration period for which issued or
2after the expiration date set pursuant to Sections 3-414 and
33-414.1 of this Code.
4    (g) A person may not operate any motor vehicle that is
5equipped with registration plate covers. A violation of this
6subsection (g) or a similar provision of a local ordinance is
7an offense against laws and ordinances regulating the movement
8of traffic.
9    (h) A person may not sell or offer for sale a registration
10plate cover. A violation of this subsection (h) is a business
11offense.
12    (i) A person may not advertise for the purpose of promoting
13the sale of registration plate covers. A violation of this
14subsection (i) is a business offense.
15    (j) A person may not modify the original manufacturer's
16mounting location of the rear registration plate on any vehicle
17so as to conceal the registration or to knowingly cause it to
18be obstructed in an effort to hinder a peace officer from
19obtaining the registration for the enforcement of a violation
20of this Code, Section 27.1 of the Toll Highway Act concerning
21toll evasion, or any municipal ordinance. Modifications
22prohibited by this subsection (j) include but are not limited
23to the use of an electronic device. A violation of this
24subsection (j) is a Class A misdemeanor.

1    (625 ILCS 5/3-804.01)
2    Sec. 3-804.01. Expanded-use antique vehicles.
3    (a) The owner of a motor vehicle that is more than 25 years
4of age or a bona fide replica thereof may register the vehicle
5as an expanded-use antique vehicle. In addition to the
6appropriate registration and renewal fees, the fee for
7expanded-use antique vehicle registration and renewal shall be
8$45 per year. The application for registration must be
9accompanied by an affirmation of the owner that:
10        (1) (blank); from January 1 through March 31 and from
11    November 1 through December 31, the vehicle will be driven
12    on the highways only for the purpose of going to and
13    returning from an antique auto show or an exhibition, or
14    for servicing or demonstration; and
15        (2) the mechanical condition, physical condition,
16    brakes, lights, glass, and appearance of such vehicle is
17    the same or as safe as originally equipped.
18    From April 1 through October 31, a vehicle registered as an
19expanded-use antique vehicle may be driven on the highways
20without being subject to the restrictions set forth in
21subdivision (1). The Secretary may prescribe, in the
22Secretary's discretion, that expanded-use antique vehicle
23plates be issued for a definite or an indefinite term, such
24term to correspond to the term of registration plates issued
25generally, as provided in Section 3-414.1. Any person
26requesting expanded-use antique vehicle plates under this

1Section may also apply to have vanity or personalized plates as
2provided under Section 3-405.1.
3    (b) Any person who is the registered owner of an
4expanded-use antique vehicle may display a historical license
5plate from or representing the model year of the vehicle,
6furnished by such person, in lieu of the current and valid
7Illinois expanded-use antique vehicle plates issued thereto,
8provided that the valid and current Illinois expanded-use
9antique vehicle plates and registration card issued to the
10expanded-use antique vehicle are simultaneously carried within
11the vehicle and are available for inspection.
12    (c) The Secretary may credit a pro-rated portion of a fee
13previously paid for an antique vehicle registration under
14Section 3-804 to an owner who applies to have that vehicle
15registered as an expanded-use antique vehicle instead of an
16antique vehicle.
