1 AMENDMENT TO SENATE BILL 3106
2     AMENDMENT NO. ______. Amend Senate Bill 3106 by replacing
3 everything after the enacting clause with the following:

4     "Section 5. The Local Records Act is amended by adding
5 Section 20 as follows:

6     (50 ILCS 205/20 new)
7     Sec. 20. Internet posting requirements.
8     (a) A unit of local government or school district that
9 serves a population of less than 1,000,000 that maintains an
10 Internet website other than a social media website or social
11 networking website shall, within 90 days of the effective date
12 of this amendatory Act of the 98th General Assembly, post to
13 its website for the current calendar year a mechanism for
14 members of the public to electronically communicate with each
15 individual elected official of that unit of local government or
16 school district.

1     (b) For the purposes of this Section "Internet website"
2 shall not include any social media website, social networking
3 website, or any other social media presence that a unit of
4 local government or school district maintains.
5     (c) The information required to be posted under this
6 Section must be easily accessible from the unit of local
7 government's or school district's home page and searchable.
8     (d) The postings required by this Section are in addition
9 to any other posting requirements required by law or ordinance.
10     (e) No home rule unit may adopt posting requirements that
11 are less restrictive than this Section. This Section is a
12 limitation under subsection (i) of Section 6 of Article VII of
13 the Illinois Constitution on the concurrent exercise by home
14 rule units of powers and functions exercised by the State.

15     Section 90. The State Mandates Act is amended by adding
16 Section 8.38 as follows:

17     (30 ILCS 805/8.38 new)
18     Sec. 8.38. Exempt mandate. Notwithstanding Sections 6 and 8
19 of this Act, no reimbursement by the State is required for the
20 implementation of any mandate created by this amendatory Act of
21 the 98th General Assembly.".
