AMENDMENT TO HOUSE BILL 5024

2    AMENDMENT NO. ______. Amend House Bill 5024 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The School Code is amended by changing Section
53-1 as follows:
 
6    (105 ILCS 5/3-1)  (from Ch. 122, par. 3-1)
7    Sec. 3-1. Election; eligibility. Quadrennially there shall
8be elected in every county, except those which have been
9consolidated into a multicounty educational service region
10under Article 3A and except those having a population of
112,000,000 or more inhabitants, a regional superintendent of
12schools, who shall enter upon the discharge of his duties on
13the first Monday of August next after his election; provided,
14however, that the term of office of each regional
15superintendent of schools in office on June 30, 2003 is
16terminated on July 1, 2003, except that an incumbent regional

1superintendent of schools shall continue to serve until his
2successor is elected and qualified, and each regional
3superintendent of schools elected at the general election in
42002 and every four years thereafter shall assume office on the
5first day of July next after his election. No one is eligible
6to file his or her petition at any primary election for the
7nomination as candidate for the office of regional
8superintendent of schools nor to enter upon the duties of such
9office either by election or appointment unless he or she
10possesses the following qualifications:
11        (1) he or she is of good character; ,
12        (2) he or she has a master's degree in education; ,
13        (3) he has earned at least 20 semester hours of credit
14    in professional education at the graduate level,
15        (3) he or she has had at least 4 years of experience in
16    teaching at any grade level, kindergarten through the
17    university graduate level; and
18        (4) he or she holds a valid all grade supervisory
19    license, a valid State limited supervisory license, a valid
20    state life supervisory license, or a valid administrative
21    license; or he or she will have on staff an assistant
22    regional superintendent of schools who meets the
23    requirements of Section 3-15.10 of this Code, as signed by
24    an affidavit filed with the State Board of Education, and
25    has been employed with the regional office of education for
26    which he or she is seeking to serve as regional

1    superintendent of schools for a minimum of 5 years in an
2    administrative capacity. ,
3        (5) he has had at least 4 years experience in teaching,
4    and
5        (6) he was engaged for at least 2 years of the 4
6    previous years in full time teaching or supervising in the
7    common public schools or serving as a county superintendent
8    of schools or regional superintendent of schools for an
9    educational service region in the State of Illinois.
10    No petition of any candidate for nomination for the office
11of regional superintendent of schools may be filed and no such
12candidate's name may be placed on a primary or general election
13ballot, unless such candidate files as part of his petition a
14certificate from the State Board of Education certifying that
15from the records of its office such candidate has the
16qualifications required by this Section; however, any
17incumbent filing his petition for nomination for a succeeding
18term of office shall not be required to attach such certificate
19to his petition of candidacy.
20    Nomination papers filed under this Section are not valid
21unless the candidate named therein files with the county clerk
22or State Board of Elections a statement of economic interests
23as required by the Illinois Governmental Ethics Act. Such
24receipt shall be so filed either previously during the calendar
25year in which his nomination papers were filed or within the
26period for the filing of nomination papers in accordance with

1the general election law.
2    The changes in qualifications made by Public Act 76-1563 do
3not affect the right of an incumbent to seek reelection. The
4changes in qualifications made by this amendatory Act of the
599th General Assembly do not affect the right of an incumbent
6to serve the remainder of his or her term.
7    On and after July 1, 1994, the provisions of this Section
8shall have no application in any educational service region
9having a population of 2,000,000 or more inhabitants; provided
10further that no election shall be held in November of 1994 or
11at any other time after July 1, 1992 for the office of regional
12superintendent of schools in any county or educational service
13region having a population of 2,000,000 or more inhabitants.

15    Section 99. Effective date. This Act takes effect upon
16becoming law.".
