1 AMENDMENT TO HOUSE BILL 5539
2 AMENDMENT NO. ______. Amend House Bill 5539, AS AMENDED,
3 with reference to page and line numbers of Senate Amendment No.
4 1, by replacing lines 1 through 5 on page 18 with
5 "Notwithstanding any other provision to the contrary, the
6 Department shall not seek recovery of overpayments,
7 adjustments, or other amounts due that are more than 6 years
8 old, unless during the 6-year period an active investigation is
9 initiated by the Department of State Police or any other State
10 or federal law enforcement agency in which case the 6-year
11 limitation for the recovery of overpayments, adjustments, or
12 other amounts due is tolled for the period of time the matter
13 is under investigation or prosecution.".
