AMENDMENT TO HOUSE BILL 2394

2    AMENDMENT NO. ______. Amend House Bill 2394 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The University of Illinois Act is amended by
5changing Section 7e-5 and by adding Section 100 as follows:
 
6    (110 ILCS 305/7e-5)
7    Sec. 7e-5. In-state tuition charge.
8    (a) Notwithstanding any other provision of law to the
9contrary, for tuition purposes, the Board of Trustees shall
10deem an individual an Illinois resident, until the individual
11establishes a residence outside of this State, if all of the
12following conditions are met:
13        (1) The individual resided with his or her parent or
14    guardian while attending a public or private high school in
15    this State.
16        (2) The individual graduated from a public or private

1    high school or received the equivalent of a high school
2    diploma in this State.
3        (3) The individual attended school in this State for at
4    least 3 years as of the date the individual graduated from
5    high school or received the equivalent of a high school
6    diploma.
7        (4) The individual registers as an entering student in
8    the University not earlier than the 2003 fall semester.
9        (5) In the case of an individual who is not a citizen
10    or a permanent resident of the United States, the
11    individual provides the University with an affidavit
12    stating that the individual will file an application to
13    become a permanent resident of the United States at the
14    earliest opportunity the individual is eligible to do so.
15    This subsection (a) applies only to tuition for a term or
16semester that begins on or after May 20, 2003 (the effective
17date of Public Act 93-7). Any revenue lost by the University in
18implementing this subsection (a) shall be absorbed by the
19University Income Fund.
20    (b) If a person is on active military duty and stationed in
21Illinois, then the Board of Trustees shall deem that person and
22any of his or her dependents Illinois residents for tuition
23purposes. Beginning with the 2009-2010 academic year, if a
24person is on active military duty and is stationed out of
25State, but he or she was stationed in this State for at least 3
26years immediately prior to being reassigned out of State, then

1the Board of Trustees shall deem that person and any of his or
2her dependents Illinois residents for tuition purposes, as long
3as that person or his or her dependent (i) applies for
4admission to the University within 18 months of the person on
5active military duty being reassigned or (ii) remains
6continuously enrolled at the University. Beginning with the
72013-2014 academic year, if a person is utilizing benefits
8under the federal Post-9/11 Veterans Educational Assistance
9Act of 2008 or any subsequent variation of that Act, then the
10Board of Trustees shall deem that person an Illinois resident
11for tuition purposes. Beginning with the 2015-2016 academic
12year, if a person is utilizing benefits under the federal
13All-Volunteer Force Educational Assistance Program, then the
14Board of Trustees shall deem that person an Illinois resident
15for tuition purposes.
16    (c) Notwithstanding any other provision of law to the
17contrary, a student who meets the requirements of subsection
18(a) of this Section is eligible to apply or receive
19consideration for any student aid or benefit funded or
20administered by the State, State agencies, public
21institutions, or the University, including, but not limited to,
22scholarships, grants, awards, stipends, room and board,
23tuition waivers, or other financial or in-kind assistance, with
24the exception of Monetary Award Program grants. The General
25Assembly finds and declares that this Section is a State law
26within the meaning of subsection (d) of Section 1621 of Title 8

4    Sec. 100. Qualification for financial aid. A student of the
5University who is a resident of this State and who has lost his
6or her eligibility for federal financial aid due to
7non-financial federal criteria that has not been adopted by the
8General Assembly shall retain his or her eligibility for
9student aid or benefits funded or administered by the State, a
10State agency, a public institution, or the University,
11including, but not limited to, scholarships, grants, awards,
12stipends, room and board costs, tuition waivers, or other
13financial or in-kind assistance.
 
14    Section 10. The Southern Illinois University Management
15Act is amended by changing Section 8d-5 and by adding Section
1685 as follows:
 
17    (110 ILCS 520/8d-5)
18    Sec. 8d-5. In-state tuition charge.
19    (a) Notwithstanding any other provision of law to the
20contrary, for tuition purposes, the Board shall deem an
21individual an Illinois resident, until the individual
22establishes a residence outside of this State, if all of the
23following conditions are met:

1        (1) The individual resided with his or her parent or
2    guardian while attending a public or private high school in
3    this State.
4        (2) The individual graduated from a public or private
5    high school or received the equivalent of a high school
6    diploma in this State.
7        (3) The individual attended school in this State for at
8    least 3 years as of the date the individual graduated from
9    high school or received the equivalent of a high school
10    diploma.
11        (4) The individual registers as an entering student in
12    the University not earlier than the 2003 fall semester.
13        (5) In the case of an individual who is not a citizen
14    or a permanent resident of the United States, the
15    individual provides the University with an affidavit
16    stating that the individual will file an application to
17    become a permanent resident of the United States at the
18    earliest opportunity the individual is eligible to do so.
19    This subsection (a) applies only to tuition for a term or
20semester that begins on or after May 20, 2003 (the effective
21date of Public Act 93-7). Any revenue lost by the University in
22implementing this subsection (a) shall be absorbed by the
23University Income Fund.

22contrary, for tuition purposes, the Board shall deem an

11    (b) If a person is on active military duty and stationed in
12Illinois, then the Board shall deem that person and any of his
13or her dependents Illinois residents for tuition purposes.
14Beginning with the 2009-2010 academic year, if a person is on
15active military duty and is stationed out of State, but he or
16she was stationed in this State for at least 3 years
17immediately prior to being reassigned out of State, then the
18Board shall deem that person and any of his or her dependents
19Illinois residents for tuition purposes, as long as that person
20or his or her dependent (i) applies for admission to the
21University within 18 months of the person on active military
22duty being reassigned or (ii) remains continuously enrolled at
23the University. Beginning with the 2013-2014 academic year, if
24a person is utilizing benefits under the federal Post-9/11
25Veterans Educational Assistance Act of 2008 or any subsequent

7contrary, a student who meets the requirements of subsection
8(a) of this Section is eligible to apply or receive
9consideration for any student aid or benefit funded or
10administered by the State, State agencies, public
11institutions, or the University, including, but not limited to,
12scholarships, grants, awards, stipends, room and board,
13tuition waivers, or other financial or in-kind assistance, with
14the exception of Monetary Award Program grants. The General
15Assembly finds and declares that this Section is a State law
16within the meaning of subsection (d) of Section 1621 of Title 8
17of the United States Code.

5    Section 40. The Northern Illinois University Law is amended
6by changing Section 30-88 and by adding Section 30-205 as
7follows:
 
8    (110 ILCS 685/30-88)
9    Sec. 30-88. In-state tuition charge.
10    (a) Notwithstanding any other provision of law to the
11contrary, for tuition purposes, the Board shall deem an
12individual an Illinois resident, until the individual
13establishes a residence outside of this State, if all of the
14following conditions are met:
15        (1) The individual resided with his or her parent or
16    guardian while attending a public or private high school in
17    this State.
18        (2) The individual graduated from a public or private
19    high school or received the equivalent of a high school
20    diploma in this State.
21        (3) The individual attended school in this State for at
22    least 3 years as of the date the individual graduated from
23    high school or received the equivalent of a high school
24    diploma.

1        (4) The individual registers as an entering student in
2    the University not earlier than the 2003 fall semester.
3        (5) In the case of an individual who is not a citizen
4    or a permanent resident of the United States, the
5    individual provides the University with an affidavit
6    stating that the individual will file an application to
7    become a permanent resident of the United States at the
8    earliest opportunity the individual is eligible to do so.
9    This subsection (a) applies only to tuition for a term or
10semester that begins on or after May 20, 2003 (the effective
11date of Public Act 93-7). Any revenue lost by the University in
12implementing this subsection (a) shall be absorbed by the
13University Income Fund.
14    (b) If a person is on active military duty and stationed in

14    Sec. 20. Functions of Commission.
15    (a) The Commission, in accordance with this Act, shall
16prepare and supervise the issuance of public information
17concerning its provisions; prescribe the form and regulate the
18submission of applications for assistance; provide for and
19conduct, or cause to be conducted, all eligibility
20determinations of applicants; award the appropriate financial
21assistance; and, upon request by a member of the General
22Assembly, nominate or evaluate and recommend for nomination
23applicants for General Assembly scholarships in accordance
24with criteria specified by the member under Section 30-9 of the

1School Code.
2    (b) The Commission is authorized to participate in any
3programs for monetary assistance to students and to receive,
4hold, and disburse all such funds made available by any agency
5or organization for the purpose or purposes for which they are
6made available. The Commission is authorized to administer a
7program of grant assistance as authorized by the Baccalaureate
8Savings Act. The Commission is authorized to participate in any
9programs established to improve student financial aid services
10or the proficiency of persons engaged in student financial aid
11services and to receive, hold, and disburse all funds made
12available by any agency or organization for the purpose or
13purposes for which they are made available subject to the
14appropriations of the General Assembly.
15    (c) The Commission is authorized to deny a scholarship or a
16grant to any person who has defaulted on a guaranteed student
17loan and who is not maintaining a satisfactory repayment
18record. If a person has a defaulted guaranteed student loan but
19is otherwise eligible for assistance pursuant to Section 40,
20the Commission shall award one term of assistance during which
21a satisfactory repayment record must be established. If such a
22repayment record is not established, additional assistance
23shall be denied until a satisfactory repayment record is
24established.
25    (c-5) A person who is a resident of this State and who has
26lost his or her eligibility for federal financial aid due to

1non-financial federal criteria that has not been adopted by the
2Commission and the General Assembly shall retain his or her
3eligibility for student aid or benefits funded or administered
4by the State, a State agency, a public institution, or an
5institution of higher learning, including, but not limited to,
6scholarships, grants, awards, stipends, room and board costs,
7tuition waivers, or other financial or in-kind assistance.
8    (d) The Commission is authorized to participate with
9federal, state, county, local, and university law enforcement
10agencies in cooperative efforts to detect and prosecute
11incidents of fraud in student assistance programs.
12    (e) The Administrative Review Law shall apply to and govern
13all proceedings for the judicial review of final administrative
14decisions of the Commission.
15    (f) The Commission is authorized to make all necessary and
16proper rules, not inconsistent with this Act, for the efficient
17exercise of the foregoing functions.
18    (g) Unless otherwise provided by statute, the functions of
19the Commission shall be exercised without regard to any
20applicant's race, creed, sex, color, national origin, or
21ancestry.
22    (h) The Commission is authorized to establish systems and
23programs to encourage employers to match employee
24contributions to prepaid programs of college savings by making
25donations to the Commission for prepaid programs of college
26savings to make higher education affordable for all residents
