AMENDMENT TO HOUSE BILL 2394

2    AMENDMENT NO. ______. Amend House Bill 2394 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The University of Illinois Act is amended by
5changing Section 7e-5 and by adding Section 100 as follows:
 
6    (110 ILCS 305/7e-5)
7    Sec. 7e-5. In-state tuition charge.
8    (a) Notwithstanding any other provision of law to the
9contrary, for tuition purposes, the Board of Trustees shall
10deem an individual an Illinois resident, until the individual
11establishes a residence outside of this State, if all of the
12following conditions are met:
13        (1) The individual resided with his or her parent or
14    guardian while attending a public or private high school in
15    this State.
16        (2) The individual graduated from a public or private

1    high school or received the equivalent of a high school
2    diploma in this State.
3        (3) The individual attended school in this State for at
4    least 3 years as of the date the individual graduated from
5    high school or received the equivalent of a high school
6    diploma.
7        (4) The individual registers as an entering student in
8    the University not earlier than the 2003 fall semester.
9        (5) In the case of an individual who is not a citizen
10    or a permanent resident of the United States, the
11    individual provides the University with an affidavit
12    stating that the individual will file an application to
13    become a permanent resident of the United States at the
14    earliest opportunity the individual is eligible to do so.
15    This subsection (a) applies only to tuition for a term or
16semester that begins on or after May 20, 2003 (the effective
17date of Public Act 93-7). Any revenue lost by the University in
18implementing this subsection (a) shall be absorbed by the
19University Income Fund.
20    (b) If a person is on active military duty and stationed in
21Illinois, then the Board of Trustees shall deem that person and
22any of his or her dependents Illinois residents for tuition
23purposes. Beginning with the 2009-2010 academic year, if a
24person is on active military duty and is stationed out of
25State, but he or she was stationed in this State for at least 3
26years immediately prior to being reassigned out of State, then

1the Board of Trustees shall deem that person and any of his or
2her dependents Illinois residents for tuition purposes, as long
3as that person or his or her dependent (i) applies for
4admission to the University within 18 months of the person on
5active military duty being reassigned or (ii) remains
6continuously enrolled at the University. Beginning with the
72013-2014 academic year, if a person is utilizing benefits
8under the federal Post-9/11 Veterans Educational Assistance
9Act of 2008 or any subsequent variation of that Act, then the
10Board of Trustees shall deem that person an Illinois resident
11for tuition purposes. Beginning with the 2015-2016 academic
12year, if a person is utilizing benefits under the federal
13All-Volunteer Force Educational Assistance Program, then the
14Board of Trustees shall deem that person an Illinois resident
15for tuition purposes.
16    (c) Notwithstanding any other provision of law to the
17contrary, a student who meets the requirements of subsection
18(a) of this Section is eligible to apply or receive
19consideration for any student aid or benefit funded or
20administered by the State, State agencies, public
21institutions, or the University, including, but not limited to,
22scholarships, grants, awards, stipends, room and board,
23tuition waivers, or other financial or in-kind assistance, with
24the exception of Monetary Award Program grants. The General
25Assembly finds and declares that this Section is a State law
26within the meaning of subsection (d) of Section 1621 of Title 8

4    Sec. 100. Eligibility for financial aid. A resident of this
5State who has lost his or her eligibility for federal financial
6aid due to non-financial federal criteria that has not been
7adopted by the General Assembly shall retain his or her
8eligibility for non-federal student aid or benefits funded or
9administered by the State, a State agency, a public
10institution, or the University, including, but not limited to,
11scholarships, grants, awards, stipends, room and board costs,
12tuition waivers, or other financial or in-kind assistance.
 
13    Section 10. The Southern Illinois University Management
14Act is amended by changing Section 8d-5 and by adding Section
1585 as follows:
 
16    (110 ILCS 520/8d-5)
17    Sec. 8d-5. In-state tuition charge.
18    (a) Notwithstanding any other provision of law to the
19contrary, for tuition purposes, the Board shall deem an
20individual an Illinois resident, until the individual
21establishes a residence outside of this State, if all of the
22following conditions are met:
23        (1) The individual resided with his or her parent or

1    guardian while attending a public or private high school in
2    this State.
3        (2) The individual graduated from a public or private
4    high school or received the equivalent of a high school
5    diploma in this State.
6        (3) The individual attended school in this State for at
7    least 3 years as of the date the individual graduated from
8    high school or received the equivalent of a high school
9    diploma.
10        (4) The individual registers as an entering student in
11    the University not earlier than the 2003 fall semester.
12        (5) In the case of an individual who is not a citizen
13    or a permanent resident of the United States, the
14    individual provides the University with an affidavit
15    stating that the individual will file an application to
16    become a permanent resident of the United States at the
17    earliest opportunity the individual is eligible to do so.
18    This subsection (a) applies only to tuition for a term or
19semester that begins on or after May 20, 2003 (the effective
20date of Public Act 93-7). Any revenue lost by the University in
21implementing this subsection (a) shall be absorbed by the
22University Income Fund.

20contrary, for tuition purposes, the Board shall deem an
21individual an Illinois resident, until the individual

14or his or her dependent (i) applies for admission to the
15University within 18 months of the person on active military
16duty being reassigned or (ii) remains continuously enrolled at
17the University. Beginning with the 2013-2014 academic year, if
18a person is utilizing benefits under the federal Post-9/11
19Veterans Educational Assistance Act of 2008 or any subsequent
20variation of that Act, then the Board shall deem that person an
21Illinois resident for tuition purposes. Beginning with the
222015-2016 academic year, if a person is utilizing benefits
23under the federal All-Volunteer Force Educational Assistance
24Program, then the Board shall deem that person an Illinois
25resident for tuition purposes.

7tuition waivers, or other financial or in-kind assistance, with
8the exception of Monetary Award Program grants. The General
9Assembly finds and declares that this Section is a State law
10within the meaning of subsection (d) of Section 1621 of Title 8
11of the United States Code.

21scholarships, grants, awards, stipends, room and board costs,
22tuition waivers, or other financial or in-kind assistance.
 
23    Section 40. The Northern Illinois University Law is amended

3    Sec. 30-88. In-state tuition charge.
4    (a) Notwithstanding any other provision of law to the
5contrary, for tuition purposes, the Board shall deem an
6individual an Illinois resident, until the individual
7establishes a residence outside of this State, if all of the
8following conditions are met:
9        (1) The individual resided with his or her parent or
10    guardian while attending a public or private high school in
11    this State.
12        (2) The individual graduated from a public or private
13    high school or received the equivalent of a high school
14    diploma in this State.
15        (3) The individual attended school in this State for at
16    least 3 years as of the date the individual graduated from
17    high school or received the equivalent of a high school
18    diploma.
19        (4) The individual registers as an entering student in
20    the University not earlier than the 2003 fall semester.
21        (5) In the case of an individual who is not a citizen
22    or a permanent resident of the United States, the
23    individual provides the University with an affidavit
24    stating that the individual will file an application to
25    become a permanent resident of the United States at the

1    earliest opportunity the individual is eligible to do so.
2    This subsection (a) applies only to tuition for a term or
3semester that begins on or after May 20, 2003 (the effective
4date of Public Act 93-7). Any revenue lost by the University in
5implementing this subsection (a) shall be absorbed by the
6University Income Fund.
7    (b) If a person is on active military duty and stationed in

2    Section 50. The Higher Education Student Assistance Act is
3amended by changing Section 20 as follows:
 
4    (110 ILCS 947/20)
5    Sec. 20. Functions of Commission.
6    (a) The Commission, in accordance with this Act, shall
7prepare and supervise the issuance of public information
8concerning its provisions; prescribe the form and regulate the
9submission of applications for assistance; provide for and
10conduct, or cause to be conducted, all eligibility
11determinations of applicants; award the appropriate financial
12assistance; and, upon request by a member of the General
13Assembly, nominate or evaluate and recommend for nomination
14applicants for General Assembly scholarships in accordance
15with criteria specified by the member under Section 30-9 of the
16School Code.
17    (b) The Commission is authorized to participate in any
18programs for monetary assistance to students and to receive,
19hold, and disburse all such funds made available by any agency
20or organization for the purpose or purposes for which they are
21made available. The Commission is authorized to administer a
22program of grant assistance as authorized by the Baccalaureate
23Savings Act. The Commission is authorized to participate in any
24programs established to improve student financial aid services

1or the proficiency of persons engaged in student financial aid
2services and to receive, hold, and disburse all funds made
3available by any agency or organization for the purpose or
4purposes for which they are made available subject to the
5appropriations of the General Assembly.
6    (c) The Commission is authorized to deny a scholarship or a
7grant to any person who has defaulted on a guaranteed student
8loan and who is not maintaining a satisfactory repayment
9record. If a person has a defaulted guaranteed student loan but
10is otherwise eligible for assistance pursuant to Section 40,
11the Commission shall award one term of assistance during which
12a satisfactory repayment record must be established. If such a
13repayment record is not established, additional assistance
14shall be denied until a satisfactory repayment record is
15established.
16    (c-5) A resident of this State who has lost his or her
17eligibility for federal financial aid due to non-financial
18federal criteria that has not been adopted by the Commission
19and the General Assembly shall retain his or her eligibility
20for non-federal student aid or benefits funded or administered
21by the State, a State agency, a public institution, or an
22institution of higher learning, including, but not limited to,
23scholarships, grants, awards, stipends, room and board costs,
24tuition waivers, or other financial or in-kind assistance.
25    (d) The Commission is authorized to participate with
26federal, state, county, local, and university law enforcement

1agencies in cooperative efforts to detect and prosecute
2incidents of fraud in student assistance programs.
3    (e) The Administrative Review Law shall apply to and govern
4all proceedings for the judicial review of final administrative
5decisions of the Commission.
6    (f) The Commission is authorized to make all necessary and
7proper rules, not inconsistent with this Act, for the efficient
8exercise of the foregoing functions.
9    (g) Unless otherwise provided by statute, the functions of
10the Commission shall be exercised without regard to any
11applicant's race, creed, sex, color, national origin, or
12ancestry.
13    (h) The Commission is authorized to establish systems and
14programs to encourage employers to match employee
15contributions to prepaid programs of college savings by making
16donations to the Commission for prepaid programs of college
17savings to make higher education affordable for all residents
18of the State and to receive, hold, and disburse all such funds
19made available through those programs for the purposes for
20which they are authorized by rule or by law.
