AMENDMENT TO HOUSE BILL 2448

2    AMENDMENT NO. ______. Amend House Bill 2448, AS AMENDED, by
3replacing everything after the enacting clause with the
4following:
 
5    "Section 5. The Illinois Vehicle Code is amended by
6changing Section 12-201 as follows:
 
7    (625 ILCS 5/12-201)  (from Ch. 95 1/2, par. 12-201)
8    Sec. 12-201. When lighted lamps are required.
9    (a) When operated upon any highway in this State, every
10motorcycle shall at all times exhibit at least one lighted
11lamp, showing a white light visible for at least 500 feet in
12the direction the motorcycle is proceeding. However, in lieu of
13such lighted lamp, a motorcycle may be equipped with and use a
14means of modulating the upper beam of the head lamp between
15high and a lower brightness. No such head lamp shall be
16modulated, except to otherwise comply with this Code, during

1times when lighted lamps are required for other motor vehicles.
2    (b) All other motor vehicles shall exhibit at least 2
3lighted head lamps, with at least one on each side of the front
4of the vehicle, which satisfy United States Department of
5Transportation requirements, showing white lights, including
6that emitted by high intensity discharge (HID) lamps, or lights
7of a yellow or amber tint, during the period from sunset to
8sunrise, at times when rain, snow, fog, or other atmospheric
9conditions require the use of windshield wipers, and at any
10other times when, due to insufficient light or unfavorable
11atmospheric conditions, persons and vehicles on the highway are
12not clearly discernible at a distance of 1000 feet. Parking
13lamps may be used in addition to but not in lieu of such head
14lamps. Every motor vehicle, trailer, or semi-trailer shall also
15exhibit at least 2 lighted lamps, commonly known as tail lamps,
16which shall be mounted on the left rear and right rear of the
17vehicle so as to throw a red light visible for at least 500
18feet in the reverse direction, except that a truck tractor or
19road tractor manufactured before January 1, 1968 and all
20motorcycles need be equipped with only one such tail lamp.
21    (b-5) During all other times not specified under subsection
22(b) of this Section, when operated upon a Class II or Class III
23highway with 2 lanes of traffic outside the corporate limits of
24a municipality, every motor vehicle of the first division or
25motor vehicle of the second division weighing no more than
268,000 pounds shall at all times exhibit: (1) daytime running

1lights; or (2) at least 2 lighted head lamps, with at least one
2on each side of the front of the vehicle, and which satisfy
3United States Department of Transportation requirements,
4showing white lights, including those emitted by high intensity
5discharge (HID) lamps or lights of a yellow or amber tint. A
6violation of this subsection (b-5) is a business offense
7punishable by a fine of $100.
8    For purposes of this subsection (b-5), "daytime running
9lights" means an automotive lighting device on the front of a
10motor vehicle that is automatically switched on when the
11vehicle is moving forward and emits a white, yellow, or amber
12light.
13    (c) Either a tail lamp or a separate lamp shall be so
14constructed and placed as to illuminate with a white light a
15rear registration plate when required and render it clearly
16legible from a distance of 50 feet to the rear. Any tail lamp
17or tail lamps, together with any separate lamp or lamps for
18illuminating a rear registration plate, shall be so wired as to
19be lighted whenever the head lamps or auxiliary driving lamps
20are lighted.
21    (d) A person shall install only head lamps that satisfy
22United States Department of Transportation regulations and
23show white light, including that emitted by HID lamps, or light
24of a yellow or amber tint for use by a motor vehicle.
