AMENDMENT TO HOUSE BILL 2641

2    AMENDMENT NO. ______. Amend House Bill 2641 by replacing
3everything after the enacting clause with the following:
 
4    "Section 1. Short title. This Act may be cited as the
5Protection of Individuals with Disabilities in the Criminal
6Justice System Task Force Act.
 
7    Section 5. Protection of Individuals With Disabilities in
8the Criminal Justice System Task Force; members.
9    (a) There is created the Protection of Individuals with
10Disabilities in the Criminal Justice System Task Force ("Task
11Force") consisting of 24 members, 10 appointed by the Attorney
12General, 10 appointed by the Governor, and one each appointed
13by the Speaker of the House of Representatives, the Minority
14Leader of the House of Representatives, the President of the
15Senate, and the Minority Leader of the Senate. The appointments
16shall be made within 90 days after the effective date of this

2    (b) The members shall reflect the racial, ethnic, and
3geographic diversity and diversity of disabilities of this
4State and include:
5        (1) Judges who preside over criminal cases;
6        (2) State's Attorneys;
7        (3) Public Defenders;
8        (4) representatives of organizations that advocate for
9    persons with developmental and intellectual disabilities;
10        (5) representatives of organizations that advocate for
11    persons with physical disabilities;
12        (6) representatives of organizations that advocate for
13    persons with mental illness;
14        (7) representatives of organizations that advocate for
15    adolescents and youth;
16        (8) a representative from the State's Protection and
17    Advocacy agency;
18        (9) Sheriffs or their designees;
19        (10) Chiefs of municipal police departments or their
20    designees;
21        (11) individuals with disabilities;
22        (12) parents or guardians of individuals with
23    disabilities;
24        (13) community-based providers of services to persons
25    with disabilities; and
26        (14) a representative of a service coordination

1    agency.
2    (c) The following State officials shall serve as ex-officio
3members of the Task Force:
4        (1) a liaison of the Governor's office;
5        (2) the Attorney General or his or her designee;
6        (3) the Director of State Police or his or her
7    designee;
8        (4) the Secretary of Human Services or his or her
9    designee;
10        (5) the Director of Corrections or his or her designee;
11        (6) the Director of Juvenile Justice or his or her
12    designee;
13        (7) the Director of the Guardianship and Advocacy
14    Commission or his or her designee; and
15        (8) the Director of the Illinois Criminal Justice
16    Information Authority or his or her designee.
17    (d) The members of the Task Force shall serve without
18compensation.
19    (e) The Task Force members shall elect one of the appointed
20members to serve as a co-chair of the Task Force at the first
21meeting of the Task Force. The other co-chair shall be the
22liaison of the Governor's office.
23    (f) The Office of the Attorney General shall provide
24administrative and other support to the Task Force.
 
25    Section 10. Task Force duties. The Task Force shall

1consider issues that affect adults and juveniles with
2disabilities with respect to their involvement with the police,
3detention and confinement in correctional facilities,
4representation by counsel, participation in the criminal
5justice system, communications with their families, awareness
6and accommodations for their disabilities, and concerns for the
7safety of the general public and individuals working in the
8criminal justice system. The Task Force shall make
9recommendations to the Governor and to the General Assembly
10regarding policies, procedures, legislation, and other actions
11that can be taken to protect the public safety and the
12well-being and rights of individuals with disabilities in the
13criminal justice system.
 
14    Section 15. Meetings. The Task Force shall meet at least 4
15times, with the first meeting taking place no later than 120
16days after the effective date of this Act.
 
17    Section 20. Report. The Task Force shall submit a report
18with its findings and recommendations to the Governor, the
19Attorney General, and to the General Assembly on or before
20March 31, 2018.
 
21    Section 25. Repeal. This Act is repealed on June 30, 2018.
 
22    Section 99. Effective date. This Act takes effect upon
