AMENDMENT TO HOUSE BILL 2641

2    AMENDMENT NO. ______. Amend House Bill 2641 by replacing
3everything after the enacting clause with the following:
 
4    "Section 1. Short title. This Act may be cited as the
5Protection of Individuals with Disabilities in the Criminal
6Justice System Task Force Act.
 
7    Section 5. Protection of Individuals With Disabilities in
8the Criminal Justice System Task Force; members.
9    (a) There is created the Protection of Individuals with
10Disabilities in the Criminal Justice System Task Force ("Task
11Force") consisting of 24 members, one member appointed by the
12Attorney General, one liaison of the Office of the Governor and
1314 other members appointed by the Governor, 2 circuit judges
14appointed by the Supreme Court, one member appointed by the
15State Treasurer, one member appointed by the Guardianship and
16Advocacy Commission, and 4 members of the General Assembly, one

1each appointed by the Speaker of the House of Representatives,
2the Minority Leader of the House of Representatives, the
3President of the Senate, and the Minority Leader of the Senate.
4The appointments shall be made within 90 days after the
5effective date of this Act.
6    (b) The members shall reflect the racial, ethnic, and
7geographic diversity and diversity of disabilities of this
8State and include:
9        (1) Circuit judges who preside over criminal cases;
10        (2) State's Attorneys;
11        (3) Public Defenders;
12        (4) representatives of organizations that advocate for
13    persons with developmental and intellectual disabilities;
14        (5) representatives of organizations that advocate for
15    persons with physical disabilities;
16        (6) representatives of organizations that advocate for
17    persons with mental illness;
18        (7) representatives of organizations that advocate for
19    adolescents and youth;
20        (8) a representative from the Guardianship and
21    Advocacy Commission;
22        (9) sheriffs or their designees;
23        (10) chiefs of municipal police departments or their
24    designees;
25        (11) individuals with disabilities;
26        (12) parents or guardians of individuals with

1    disabilities;
2        (13) community-based providers of services to persons
3    with disabilities; and
4        (14) a representative of a service coordination
5    agency.
6    (c) The following State officials shall serve as ex-officio
7members of the Task Force:
8        (1) a liaison of the Governor's Office;
9        (2) the Attorney General or his or her designee;
10        (3) the Director of State Police or his or her
11    designee;
12        (4) the Secretary of Human Services or his or her
13    designee;
14        (5) the Director of Corrections or his or her designee;
15        (6) the Director of Juvenile Justice or his or her
16    designee;
17        (7) the Director of the Guardianship and Advocacy
18    Commission or his or her designee;
19        (8) the Director of the Illinois Criminal Justice
20    Information Authority or his or her designee; and
21        (9) the State Treasurer or his or her designee.
22    (d) The members of the Task Force shall serve without
23compensation.
24    (e) The Task Force members shall elect one of the appointed
25members to serve as a co-chair of the Task Force at the first
26meeting of the Task Force. The other co-chair shall be the

1liaison of the Governor's Office.
2    (f) The Guardianship and Advocacy Commission shall provide
3administrative and other support to the Task Force.
 
4    Section 10. Task Force duties. The Task Force shall
5consider issues that affect adults and juveniles with
6disabilities with respect to their involvement with the police,
7detention and confinement in correctional facilities,
8representation by counsel, participation in the criminal
9justice system, communications with their families, awareness
10and accommodations for their disabilities, and concerns for the
11safety of the general public and individuals working in the
12criminal justice system. The Task Force shall make
13recommendations to the Governor and to the General Assembly
14regarding policies, procedures, legislation, and other actions
15that can be taken to protect the public safety and the
16well-being and rights of individuals with disabilities in the
17criminal justice system.
 
18    Section 15. Meetings. The Task Force shall meet at least 4
19times, with the first meeting taking place no later than 120
20days after the effective date of this Act.
 
21    Section 20. Report. The Task Force shall submit a report
22with its findings and recommendations to the Governor, the
23Attorney General, and to the General Assembly on or before

1March 31, 2018.
 
2    Section 25. Repeal. This Act is repealed on June 30, 2018.
 
3    Section 99. Effective date. This Act takes effect upon
4becoming law.".
