AMENDMENT TO HOUSE BILL 5021

2    AMENDMENT NO. ______. Amend House Bill 5021 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Board of Higher Education Act is amended by
5adding Section 16 as follows:
 
6    (110 ILCS 205/16 new)
7    Sec. 16. Closing an institution of higher education;
8student records.
9    (a) In this Section:
10    "Academic records" means the academic records of each
11former student of an institution of higher education that is
12traditionally provided on an academic transcript, including,
13but not limited to, courses taken, terms, grades, and any other
14similar information.
15    "Institution of higher education" means any publicly or
16privately operated university, college, junior college,

1business, technical or vocational school, or other educational
2institution offering degrees and instruction beyond the
3secondary school level. "Institution of higher education" does
4not include a public community college.
5    (b) In the event an institution of higher education
6proposes to discontinue its operations, the chief
7administrative officer of the institution shall submit a plan
8to the Board for permanent retention of all academic records of
9the institution. The plan must be approved by the Executive
10Director of the Board before it is executed.
11    (c) If it appears to the Board that the academic records of
12an institution of higher education kept pursuant to an approved
13plan under subsection (b) of this Section may become lost,
14hidden, destroyed, or otherwise made unavailable to the Board,
15the Board may seize and take possession of the records, on its
16own motion and without order of a court.
 
17    Section 99. Effective date. This Act takes effect upon
18becoming law.".
