AMENDMENT TO HOUSE BILL 5612

2    AMENDMENT NO. ______. Amend House Bill 5612, AS AMENDED,
3with reference to page and line numbers of House Amendment No.
41, on page 74, immediately below line 24, by inserting the
5following:
6    "(cccc) Notwithstanding any provision in this Section to
7the contrary, nothing in this Section shall prohibit the
8issuance or renewal of a license authorizing the sale of
9alcoholic liquor at a grocery store at premises located within
10a municipality with a population in excess of 25,000
11inhabitants and within 100 feet of a school if:
12        (1) the grocery store has been operated continuously by
13    the same family since 1956;
14        (2) the total square footage of the grocery store is
15    less than 19,000 square feet;
16        (3) the package goods alcohol beverage department of
17    the grocery store does not exceed 10% of the total square
18    footage of the grocery store;

1        (4) the sale of alcoholic beverages is not the primary
2    business activity of the grocery store;
3        (5) the school is a private school with a religious
4    affiliation, has been in existence since 1850, and is a
5    National Blue Ribbon School on the effective date of this
6    amendatory Act of the 100th General Assembly;
7        (6) the entrance to the grocery store is more than 300
8    feet from any of the entrances to the school;
9        (7) the building in which the grocery store is located
10    and the building in which the school is located are
11    separated by a large asphalt-paved parking lot and a
12    traffic-congested major avenue; and
13        (8) the school board for the school has given written
14    permission and consent to the sale of alcoholic beverages
15    at the grocery store.".
