AMENDMENT TO SENATE BILL 323

2    AMENDMENT NO. ______. Amend Senate Bill 323 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Barber, Cosmetology, Esthetics, Hair
5Braiding, and Nail Technology Act of 1985 is amended by
6changing Section 3-7 as follows:
 
7    (225 ILCS 410/3-7)  (from Ch. 111, par. 1703-7)
8    (Section scheduled to be repealed on January 1, 2026)
9    Sec. 3-7. Licensure; renewal; continuing education. The
10holder of a license issued under this Article III may renew
11that license during the month preceding the expiration date
12thereof by paying the required fee, giving such evidence as the
13Department may prescribe of completing not less than 14 hours
14of continuing education for a cosmetologist, and 24 hours of
15continuing education for a cosmetology teacher or cosmetology
16clinic teacher, within the 2 years prior to renewal. The

1training shall be in subjects approved by the Department as
2prescribed by rule upon recommendation of the Board and may
3include online instruction.
4    For the initial renewal of a cosmetologist's license which
5requires continuing education, as prescribed by rule, one hour
6of the continuing education shall include domestic violence and
7sexual assault awareness education as prescribed by rule of the
8Department. For every subsequent renewal of a cosmetologist's
9license, one hour of the continuing education may include
10domestic violence and sexual assault awareness education as
11prescribed by rule of the Department. The one-hour domestic
12violence and sexual assault awareness continuing education
13course shall be provided by a continuing education provider
14approved by the Department, except that completion from March
1512, 2016 to March 15, 2016 of a one-hour domestic violence and
16sexual assault awareness course from a domestic violence and
17sexual assault awareness organization shall satisfy this
18requirement.
19    The domestic violence and sexual assault awareness
20continuing education requirement does not apply to a
21cosmetologist licensee who is 60 years of age or older.
22    The Department may prescribe rules regarding the
23requirements for domestic violence and sexual assault
24awareness continuing education courses and teachers.
25    The Department shall establish by rule a means for the
26verification of completion of the continuing education

1required by this Section. This verification may be accomplished
2through audits of records maintained by registrants, by
3requiring the filing of continuing education certificates with
4the Department, or by other means established by the
5Department.
6    The Department, in its discretion, may waive enforcement of
7the continuing education requirement in this Section,
8including the domestic violence and sexual assault awareness
9education requirement, and shall adopt rules defining the
10standards and criteria for that waiver under the following
11circumstances:
12        (a) the licensee resides in a locality where it is
13    demonstrated that the absence of opportunities for such
14    education would interfere with the ability of the licensee
15    to provide service to the public;
16        (b) that to comply with the continuing education
17    requirements would cause a substantial financial hardship
18    on the licensee;
19        (c) that the licensee is serving in the United States
20    Armed Forces; or
21        (d) that the licensee is incapacitated due to illness.
