AMENDMENT TO SENATE BILL 1342

2    AMENDMENT NO. ______. Amend Senate Bill 1342 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Criminal Code of 2012 is amended by adding
5Section 48-11 as follows:
 
6    (720 ILCS 5/48-11 new)
7    Sec. 48-11. Unlawful use of an elephant in a traveling
8animal act.
9    (a) Definitions. As used in this Section:
10    "Mobile or traveling animal housing facility" means a
11transporting vehicle such as a truck, trailer, or railway car
12used to transport or house animals while traveling to an
13exhibition or other performance.
14    "Performance" mean an exhibition, public showing,
15presentation, display, exposition, fair, animal act, circus,
16ride, trade show, petting zoo, carnival, parade, race, or other

1similar undertaking in which animals are required to perform
2tricks, give rides, or participate as accompaniments for
3entertainment, amusement, or benefit of a live audience.
4    "Traveling animal act" means any performance of animals
5where animals are transported to, from, or between locations
6for the purpose of a performance in a mobile or traveling
7animal housing facility.
8    (b) A person commits unlawful use of an elephant in a
9traveling animal act when he or she knowingly allows for the
10participation of an African elephant (Loxodonta Africana) or
11Asian elephant (Elephas maximus) protected under the federal
12Endangered Species Act of 1973 in a traveling animal act.
13    (c) This Section does not apply to an exhibition of
14elephants at a non-mobile, permanent institution, or other
15facility.
16    (d) Sentence. Unlawful use of an elephant in a traveling
17animal act is a Class A misdemeanor.".
