SYNOPSIS AS INTRODUCED:
 
220 ILCS 5/16-115E new

    Amends the Public Utilities Act. Provides for a waste-to-energy electric generation program. Requires every investor-owned public utility to file with the Illinois Commerce Commission a standard tariff for electricity purchased from an electric generation facility. Provides that the Commission may limit the projects to 2 standard tariffs per territory in Illinois. Provides requirements for the use of the applicable tariffs, and accompanying costs. Provides that the Commission shall adopt any rules necessary to implement the program. Defines "electric generation facility". Effective immediately.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Public Utilities Act is amended by adding
5Section 16-115E as follows:
 
6    (220 ILCS 5/16-115E new)
7    Sec. 16-115E. Waste-to-energy electric generation.
8    (a) As used in this Section, "electric generation facility"
9means an electric generation facility located within the
10service territory of, and developed to sell electricity to, an
11investor-owned public utility that:
12        (1) has an effective capacity of not more than 3
13    megawatts;
14        (2) is interconnected and operates in parallel with the
15    electrical transmission and distribution grid;
16        (3) is strategically located and interconnected to the
17    electrical transmission and distribution grid in a manner
18    that optimizes the deliverability of electricity generated
19    at the facility to load centers; and
20        (4) is an eligible renewable energy resource.
21    (b) It is the policy of the State of Illinois and the
22intent of the General Assembly to encourage electrical
23generation from eligible renewable energy resources. To that

1end, the purpose of this Section is to allow wastewater plants
2to build turbines to power electricity from their waste fuel in
3order to produce another viable form of electrical generation
4for this State.
5    (c) Every investor-owned public utility shall file with the
6Commission a standard tariff for electricity purchased from an
7electric generation facility. The Commission may limit the
8projects to 2 standard tariffs per territory in Illinois. Each
9tariff shall provide for payment for every kilowatthour of
10electricity purchased from an electric generation facility for
11a period of 10, 15, or 20 years, as authorized by the
12Commission. The payment shall be the market price determined by
13the Commission, using a methodology developed by the
14Commission, and shall include all current and anticipated
15environmental compliance costs, including, but not limited to,
16mitigation of emissions of greenhouse gases and air pollution
17offsets associated with the operation of new generating
18facilities. The tariffs shall be completed within 12 months
19after the effective date of this amendatory Act of the 100th
20General Assembly.
21    (d) The Commission shall adopt any rules necessary to
22implement the program created under this Section.
 
23    Section 99. Effective date. This Act takes effect upon
24becoming law.
