AMENDMENT TO SENATE BILL 2031

2    AMENDMENT NO. ______. Amend Senate Bill 2031 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Nursing Home Care Act is amended by
5changing Section 1-123 as follows:
 
6    (210 ILCS 45/1-123)  (from Ch. 111 1/2, par. 4151-123)
7    Sec. 1-123. "Resident's representative" means a person
8other than the owner not related to the resident, or an agent
9or employee of a facility not related to the resident,
10designated in writing by a resident to be his representative,
11or the resident's guardian. "Resident's representative"
12includes:
13        (1) an individual chosen by the resident to act on
14    behalf of the resident in order to support the resident in
15    decision-making; access medical, social, or other personal
16    information of the resident; manage financial matters; or

1    receive notifications;
2        (2) a person authorized by State or federal law,
3    including, but not limited to, agents under power of
4    attorney, representative payees, and other fiduciaries, to
5    act on behalf of the resident in order to support the
6    resident in decision-making; access medical, social, or
7    other personal information of the resident; manage
8    financial matters; or receive notifications;
9        (3) a legal representative, as used in Section 712 of
10    the federal Older Americans Act (42 U.S.C. 3058g); or
11        (4) the court-appointed guardian or conservator of a
12    resident.
13Nothing in this definition is intended to expand the scope of
14authority of any resident's representative beyond that
15authority specifically authorized by the resident, State or
16federal law, or a court of competent jurisdiction.

18    Section 99. Effective date. This Act takes effect upon
19becoming law.".
