AMENDMENT TO SENATE BILL 2376

2    AMENDMENT NO. ______. Amend Senate Bill 2376 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The State Finance Act is amended by adding
5Sections 5.886 and 6z-105 as follows:
 
6    (30 ILCS 105/5.886 new)
7    Sec. 5.886. The Cook County Water Infrastructure Fund.
 
8    (30 ILCS 105/6z-105 new)
9    Sec. 6z-105. Water supplies from Lake Michigan.
10    (a) As used in this Section:
11    "Non-supplying municipality in Cook County" means a
12municipality in Cook County that receives its water from
13another municipality and does not sell its water to another
14municipality.
15    "Supplying municipality in Cook County" means a

1municipality in Cook County that either receives water directly
2from Lake Michigan or buys its water from another municipality
3and then sells some of its water to another municipality.
4    (b) The Cook County Water Infrastructure Fund is created as
5a special fund in the State treasury. Moneys in the Fund shall
6be used by the Environmental Protection Agency to make grants
7to municipalities to fund infrastructure improvements to
8facilitate water supplies from Lake Michigan for residents of
9Cook County.
10    Notwithstanding any other provision of law, the Cook County
11Water Infrastructure Fund is not subject to sweeps,
12administrative charges or chargebacks, or any other fiscal or
13budgetary maneuver that would in any way transfer any funds
14from the Cook County Water Infrastructure Fund into any other
15fund of the State.
16    (c) In making grants from the Cook County Water
17Infrastructure Fund, the Agency must prioritize water
18infrastructure projects in non-supplying municipalities in
19Cook County over water infrastructure projects in supplying
20municipalities in Cook County.
21    (d) The Environmental Protection Agency may adopt rules
22under the Illinois Administrative Procedure Act to implement
23this Section.
 
24    Section 99. Effective date. This Act takes effect upon
25becoming law.".
