AMENDMENT TO SENATE BILL 2562

2    AMENDMENT NO. ______. Amend Senate Bill 2562 on page 1, by
3replacing line 5 with "amended by changing Sections 15, 20, and
435 as follows"; and
 
5on page 3, line 17, after the semicolon, by inserting "or"; and
 
6on page 3, by replacing line 19 with "personnel. In"; and
 
7on page 3, line 22, by replacing "100" with "10,000"; and
 
8on page 4, line 11, after the period, by inserting ""Large
9scale event" does not include any demonstration, protest,
10rally, march, parade, or other gathering for the purpose of
11expressing political, religious, social, or other views.
12Drones operated under this Section cannot be equipped with
13facial recognition or biometric technology."; and

3    "(725 ILCS 167/20)
4    Sec. 20. Information retention.
5    (a) If a law enforcement agency uses a drone under Section
615 of this Act, the agency within 30 days shall destroy all
7information gathered by the drone, except that a supervisor at
8that agency may retain particular information if:
9        (1) there is reasonable suspicion that the information
10    contains evidence of criminal activity, or
11        (2) the information is relevant to an ongoing
12    investigation or pending criminal trial.
13    (b) Except as provided under subsection (c) of this
14Section, if a law enforcement agency uses a drone under
15paragraph (7) of Section 15 of this Act, the law enforcement
16agency shall destroy all information gathered by the drone
17within 7 days, except that a supervisor at that law enforcement
18agency may retain particular information if:
19        (1) there is reasonable suspicion that the information
20    contains evidence of criminal activity; or
21        (2) the information is relevant to an ongoing
22    investigation or pending criminal trial.
23    (c) If a law enforcement agency uses a drone under
24paragraph (7) of Section 15 of this Act at any demonstration,
25protest, rally, march, parade, or other gathering for the

1purpose of expressing political, religious, social, or other
2views, the law enforcement agency shall destroy all information
3gathered by the drone within 24 hours, except that a supervisor
4at that law enforcement agency may retain particular
5information if:
6        (1) there is reasonable suspicion that the information
7    contains evidence of criminal activity; or
8        (2) the information is relevant to an ongoing
9    investigation or pending criminal trial. The law
10    enforcement agency shall limit access to the information
11    gathered by the drone to the highest ranking officer
12    investigating whether there was criminal activity at the
13    event. Additionally, the information collected shall not
14    be shared it with any other member of the law enforcement
15    agency or any other agency unless the information contains
16    evidence of criminal activity or the information is
17    relevant to an ongoing investigation or pending criminal
18    trial.
