AMENDMENT TO SENATE BILL 3131

2    AMENDMENT NO. ______. Amend Senate Bill 3131 on page 5,
3line 18, after "10-204,", by inserting "13-401.1,"; and
 
4on page 122, immediately below line 3, by inserting the
5following:
 
6    "(220 ILCS 5/13-401.1)
7    (Section scheduled to be repealed on December 31, 2020)
8    Sec. 13-401.1. Interconnected voice over Internet protocol
9(VoIP) service surcharge provider registration.
10    (a) An Interconnected VoIP provider providing fixed or
11non-nomadic service in Illinois on December 1, 2010 shall
12register with the Commission no later than January 1, 2011. All
13other Interconnected VoIP providers providing fixed or
14non-nomadic service in Illinois shall register with the
15Commission at least 30 days before providing service in
16Illinois. The Commission shall prescribe a registration form no

1later than October 1, 2010. The registration form prescribed by
2the Commission shall only require the following information:
3        (1) the provider's legal name and any name under which
4    the provider does or will do business in Illinois, as
5    authorized by the Secretary of State;
6        (2) the provider's address and telephone number, along
7    with contact information for the person responsible for
8    ongoing communications with the Commission;
9        (3) a description of the provider's dispute resolution
10    process and, if any, the telephone number to initiate the
11    dispute resolution process; and
12        (4) a description of each exchange of a local exchange
13    company, in whole or in part, or the cities, towns, or
14    geographic areas, in whole or in part, in which the
15    provider is offering or proposes to offer Interconnected
16    VoIP service.
17    A provider must notify the Commission of any change in the
18information identified in paragraphs (1), (2), (3), or (4) of
19this subsection (a) within 5 business days after any such
20change.
21    An interconnected voice over Internet protocol (b) A
22provider shall charge and collect from its end-user customers,
23and remit to the appropriate authority, fees and surcharges in
24the same manner as are charged and collected upon end-user
25customers of local exchange telecommunications service and
26remitted by local exchange telecommunications companies for

1local enhanced 9-1-1 surcharges.
2    (c) A provider may designate information that it submits in
3its registration form or subsequent reports as confidential or
4proprietary, provided that the provider states the reasons the
5confidential designation is necessary. The Commission shall
6provide adequate protection for such information pursuant to
7Section 4-404 of this Act. If the Commission or any other party
8seeks public disclosure of information designated as
9confidential, the Commission shall consider the confidential
10designation in a proceeding under the Illinois Administrative
11Procedure Act, and the burden of proof to demonstrate that the
12designated information is confidential shall be upon the
13provider. Designated information shall remain confidential
14pending the Commission's determination of whether the
15information is entitled to confidential treatment. Information
16designated as confidential shall be provided to local units of
17government for purposes of assessing compliance with this
18Article as permitted under a protective order issued by the
19Commission pursuant to the Commission's rules and to the
20Attorney General pursuant to Section 6.5 of the Attorney
21General Act. Information designated as confidential under this
22Section or determined to be confidential upon Commission review
23shall only be disclosed pursuant to a valid and enforceable
24subpoena or court order or as required by the Freedom of
25Information Act.
26    (d) Notwithstanding any other provision of law to the

1contrary, the Commission shall have the authority, after notice
2and hearing, to revoke or suspend the registration of any
3provider that fails to comply with the requirements of this
4Section.
5    (e) The provisions of this Section are severable under
6Section 1.31 of the Statute on Statutes.
