SYNOPSIS AS INTRODUCED:
 
745 ILCS 49/77 new

    Amends the Good Samaritan Act. Provides that any not-for-profit organization in this State, or any volunteer, employee, or other person present on the property of the organization in the area of the temporary or emergency shelter during the time temporary or emergency shelter is provided, who in good faith provides temporary or emergency shelter without fee for no more than 60 days or nights per year to a person experiencing homelessness shall not be liable for civil damages as a result of acts or omissions, except for gross negligence, in providing the temporary or emergency shelter. Limits the applicability of the new provisions to temporary or emergency shelters operated in Kankakee County. Provides that the provisions do not apply to an organization whose primary purpose is to provide shelter to persons experiencing homelessness.

1    AN ACT concerning civil law.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Good Samaritan Act is amended by adding
5Section 77 as follows:
 
6    (745 ILCS 49/77 new)
7    Sec. 77. Temporary or emergency shelters; exemption from
8civil liability. Any not-for-profit organization in this
9State, or any volunteer, employee, or other person present on
10the property of the organization in the area of the temporary
11or emergency shelter during the time temporary or emergency
12shelter is provided, who in good faith provides temporary or
13emergency shelter without fee for no more than 60 days or
14nights per year to a person experiencing homelessness shall not
15be liable for civil damages as a result of acts or omissions,
16except for gross negligence, in providing the temporary or
17emergency shelter.
18    This Section applies only to temporary or emergency
19shelters operated in Kankakee County. This Section does not
20apply to an organization whose primary purpose is to provide
21shelter to persons experiencing homelessness.
