AMENDMENT TO SENATE BILL 1698

2    AMENDMENT NO. ______. Amend Senate Bill 1698 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Local Government Officer Compensation Act
5is amended by changing Section 25 as follows:
 
6    (50 ILCS 145/25)
7    Sec. 25. Elected official salary.
8    (a) Notwithstanding the provision of any other law to the
9contrary, an elected officer of a unit of local government that
10is a participating employer under the Illinois Municipal
11Retirement Fund shall not receive any salary or other
12compensation from the unit of local government if the member is
13receiving pension benefits from the Illinois Municipal
14Retirement Fund under Article 7 of the Illinois Pension Code
15for the elected official's service in that same elected
16position. If an elected officer is receiving benefits from the

1Illinois Municipal Retirement Fund on August 23, 2019 (the
2effective date of Public Act 101-544) this amendatory Act of
3the 101st General Assembly, the elected official's salary and
4compensation shall be reduced to zero at the beginning of the
5member's next term if the member is still receiving such
6pension benefits.
7    (b) This Section does not apply to a unit of local
8government that has adopted an ordinance or resolution
9effective prior to January 1, 2019 that: (i) reduces the
10compensation of an elected official of the unit of local
11government who is receiving pension benefits from the Illinois
12Municipal Retirement Fund under Article 7 of the Illinois
13Pension Code for his or her service as an elected official in
14the same elected position of that unit of local government; and
15(ii) changes the official's position to part-time.

17    Section 99. Effective date. This Act takes effect upon
18becoming law.".
