SYNOPSIS AS INTRODUCED:

410 ILCS 510/5 new

Amends the Cadaver Act. Creates the Cadaver Advisory Council and tasks it with creating and maintaining a document containing current embalming techniques, preservation practices, and air quality testing from universities within the State, as well as recommendations regarding the administration of an anatomical education program. Requires the document to be made available on the Department of Public Health's website and kept up to date by the Department as it is maintained by the Council. Provides that the Council shall meet at least every 6 months. Provides that the Director of Public Health shall serve as the Council's chairperson alongside other specified members, who shall serve without compensation but may be reimbursed for reasonable and necessary expenses from funds appropriated to the Department for that purpose. Provides specified responsibilities for the chairperson, in consultation with Council members. Effective July 1, 2020.

A BILL FOR

AN ACT concerning health.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Cadaver Act is amended by adding Section 5 as follows:

(410 ILCS 510/5 new)

Sec. 5. Cadaver Advisory Council.

(a) The General Assembly finds that:

(1) Embalming practices for medical education are not standardized or monitored in the United States. Labs throughout the nation use a variety of embalming solutions that may contain formaldehyde, phenol, MEA, or other chemicals. These chemicals may be influenced by temperature and regional environments, and universities cannot guarantee that the bodies students are learning from have been embalmed using the safest, most efficient processes. This could potentially create a dangerous situation for both students and educators in cadaver labs throughout the State.

(2) Therefore, it would be beneficial to both students and educators, and to all of the universities and colleges in the State, if there was created an organized group of experts to meet and discuss anatomical laboratory education safety and the safe use, transportation, and storage of cadavers used for anatomical education programs.

(b) In this Section:

"Anatomical education program" means any educational program that utilizes whole-body donation to educate students about anatomy, physiology, and disease.

"Body donation program" means any nontransplant, whole-body, or anatomical donation program that preserves cadavers, typically for medical or scientific research.

"Council" means the Cadaver Advisory Council.

"Department" means the Department of Public Health.

"Director" means the Director of Public Health.

"Institution of higher learning" means an educational organization located in this State that provides at least an organized 2-year program of collegiate grade in the liberal arts, sciences, or both, directly applicable toward the attainment of a baccalaureate degree, or a program in health education directly applicable toward the attainment of a college certificate, diploma, or associate degree.

(c) The Cadaver Advisory Council is created. The Council shall create and maintain a document containing current embalming techniques, preservation practices, and air quality testing from universities within the State, as well as recommendations regarding the administration of an anatomical education program, which shall, at a minimum, cover all of the following:

(1) acceptance of cadavers;

(2) embalming and preservation procedures;

(3) the differences between funeral embalming and embalming for medical education;

(4) facilities in which cadavers may be stored and examined;

(5) security;

(6) use of cadavers;

(7) transportation of cadavers;

(8) maintenance of written records; and

(9) final disposition of cadavers.

(d) The document created and maintained under subsection (c) shall be made available on the Department's website and kept up to date by the Department as it is maintained by the Council.

(e) The Council shall meet at least every 6 months and at other times as called by the chairperson, and shall consist of the following members:

(1) The Director, or his or her designee, who shall serve as chairperson.

(2) The Dean of the University of Illinois College of Medicine, or his or her designee.

(3) The Dean of the Southern Illinois University School of Medicine, or his or her designee.

(4) Two deans from independent universities with approved medical schools in the State, or their designees, appointed by the Director.

(5) One member representing a statewide organization that receives, prepares, preserves, and distributes human remains for the purpose of medical education and research at institutions throughout Illinois, appointed by the Director.

(6) Two members representing lab managers at institutions of higher learning that have a body donation program, appointed by the Director.

(7) Two members representing lab managers at institutions of higher learning that use cadavers from outsourced body donation programs, appointed by the Director.

(8) One member from a statewide organization representing funeral homes or funeral home directors in the State, appointed by the Governor.

(9) One member appointed by the Governor.

(f) Members of the Council shall serve without compensation but may be reimbursed for their reasonable and necessary expenses from funds appropriated to the Department for that purpose, including travel, subject to the rules of the appropriate travel control board.

(g) The chairperson shall be responsible for scheduling meetings, setting meeting agendas, ensuring the development and delivery of the final report and implementation plan, and other administrative tasks, in consultation with Council members.

Section 99. Effective date. This Act takes effect July 1, 2020.
