AMENDMENT TO SENATE BILL 3255

2    AMENDMENT NO. ______. Amend Senate Bill 3255 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Vehicle Code is amended by
5changing Section 6-105 as follows:
 
6    (625 ILCS 5/6-105)  (from Ch. 95 1/2, par. 6-105)
7    Sec. 6-105. Instruction permits and temporary licenses for
8persons 18 years of age or older.
9    (a) Except as provided in this Section, the Secretary of
10State upon receiving proper application and payment of the
11required fee may issue an instruction permit to any person 18
12years of age or older who is not ineligible for a license under
13paragraphs 1, 3, 4, 5, 7, or 8 of Section 6-103, after the
14applicant has successfully passed such examination as the
15Secretary of State in his discretion may prescribe.
16    1. An instruction permit entitles the holder while having

1the permit in his immediate possession to drive a motor
2vehicle, excluding a motor driven cycle or motorcycle, upon the
3highways for a period of 12 months after the date of its
4issuance when accompanied by a licensed driver who is 21 years
5of age or older, who has had a valid driver's license
6classification to operate such vehicle for at least one year
7and has had one year of driving experience with such
8classification and who is occupying a seat beside the driver.
9    2. A 12 month instruction permit for a motor driven cycle
10or motorcycle may be issued to a person 18 years of age or
11more, and entitles the holder to drive upon the highways during
12daylight under the direct supervision of a licensed motor
13driven cycle operator or motorcycle operator with the same or
14greater classification, who is 21 years of age or older and who
15has at least one year of driving experience.

18    (c) The Secretary of State may issue a temporary driver's
19license to an applicant for a license permitting the operation
20of a motor vehicle while the Secretary is completing an
21investigation and determination of all facts relative to such
22applicant's eligibility to receive such license, or for any
23other reason prescribed by rule or regulation promulgated by
24the Secretary of State. Such permit must be in the applicant's
25immediate possession while operating a motor vehicle, and it
26shall be invalid when the applicant's driver's license has been

1issued or for good cause has been refused. In each case the
2Secretary of State may issue the temporary driver's license for
3such period as appropriate but in no event for longer than 90
4days. The Secretary may issue such additional temporary
5driver's licenses to an applicant as are necessary to allow the
6applicant to drive during the pendency of the investigation,
7valid for such a period as is appropriate, but in no event for
8longer than 90 days each.

10    Section 99. Effective date. This Act takes effect upon
11becoming law.".
