SYNOPSIS AS INTRODUCED:
 
50 ILCS 105/4.1 new

    Amends the Public Officer Prohibited Activities Act. Provides that no officer, employee, or agent of a unit of local government may attempt to withhold disclosure to the public of information relating to tax incentives and other financial incentives by using a non-disclosure agreement. Defines "tax incentive". Effective immediately.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Public Officer Prohibited Activities Act is
5amended by adding Section 4.1 as follows:
 
6    (50 ILCS 105/4.1 new)
7    Sec. 4.1. Non-disclosure agreements.
8    (a) As used in this Section, "tax incentive" includes, but
9is not limited to, any tax incentive authorized by law that by
10exemption, exclusion, deduction, allowance, credit,
11preferential tax rate, abatement, or other device reduces the
12amount of tax revenues that would otherwise accrue to the unit
13of local government.
14    (b) No officer, employee, or agent of a unit of local
15government may attempt to withhold disclosure to the public of
16information relating to tax incentives and other financial
17incentives by using a non-disclosure agreement.
 
18    Section 99. Effective date. This Act takes effect upon
19becoming law.
