Amends the School Code. Prohibits the State Board of Education, school districts, and elementary and secondary schools from requiring the teachers, other staff, or students of a school to wear a face mask due to the COVID-19 public health emergency disaster declared by the Governor pursuant to the Illinois Emergency Management Agency Act. Effective immediately.

| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:

| 4 | | Section 5. The School Code is amended by adding Section |
| 5 | | 22-91 as follows:
|
| 6 | | (105 ILCS 5/22-91 new) |
| 7 | | Sec. 22-91. COVID-19 mask mandate prohibition. |
| 8 | | Notwithstanding any rule or other provision of law to the |
| 9 | | contrary, the State Board of Education, school districts, and |
| 10 | | elementary and secondary schools are prohibited from requiring |
| 11 | | the teachers, other staff, or students of a school to wear a |
| 12 | | face mask due to the COVID-19 public health emergency disaster |
| 13 | | declared by the Governor pursuant to Section 7 of the Illinois |
| 14 | | Emergency Management Agency Act.

| 15 | | Section 99. Effective date. This Act takes effect upon |
| 16 | | becoming law.
