AMENDMENT TO SENATE BILL 1277

2    AMENDMENT NO. ______. Amend Senate Bill 1277 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Criminal Code of 2012 is amended by
5changing Section 31-4 as follows:
 
6    (720 ILCS 5/31-4)  (from Ch. 38, par. 31-4)
7    Sec. 31-4. Obstructing justice.
8    (a) A person obstructs justice when, with intent to
9prevent the apprehension or obstruct the prosecution or
10defense of any person, he or she knowingly commits any of the
11following acts:
12        (1) Destroys, alters, conceals or disguises physical
13    evidence, plants false evidence, furnishes false
14    information; or
15        (2) Induces a witness having knowledge material to the
16    subject at issue to leave the State or conceal himself or

1    herself; or
2        (3) Possessing knowledge material to the subject at
3    issue, he or she leaves the State or conceals himself; or
4        (4) If a parent, legal guardian, or caretaker of a
5    child under 13 years of age reports materially false
6    information to a law enforcement agency, medical examiner,
7    coroner, State's Attorney, or other governmental agency
8    during an investigation of the disappearance or death of a
9    child under circumstances described in subsection (a) or
10    (b) of Section 10-10 of this Code.
11    (b) Sentence.
12        (1) Obstructing justice is a Class 4 felony, except as
13    provided in paragraph (2) of this subsection (b).
14        (2) Obstructing justice in furtherance of streetgang
15    related or gang-related activity, as defined in Section 10
16    of the Illinois Streetgang Terrorism Omnibus Prevention
17    Act, is a Class 3 felony.
18    (c) For purposes of paragraph (1) of subsection (a),
19"conceal" means hiding evidence in a manner that makes its
20discovery or recovery materially more difficult or impossible.

22    Section 99. Effective date. This Act takes effect upon
23becoming law.".
