AMENDMENT TO SENATE BILL 1305

2    AMENDMENT NO. ______. Amend Senate Bill 1305 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The School Construction Law is amended by
5changing Section 5-40 as follows:
 
6    (105 ILCS 230/5-40)
7    Sec. 5-40. Supervision of school construction projects;
8green projects. The Capital Development Board shall exercise
9general supervision over school construction projects financed
10pursuant to this Article. School districts, however, must be
11allowed to choose the architect and engineer for their school
12construction projects, and no project may be disapproved by
13the State Board of Education or the Capital Development Board
14solely due to a school district's selection of an architect or
15engineer.
16    With respect to those school construction projects for

1which a school district first applies for a grant on or after
2July 1, 2007, the school construction project must receive
3certification from the United States Green Building Council's
4Leadership in Energy and Environmental Design Green Building
5Rating System or the Green Building Initiative's Green Globes
6Green Building Rating System or must meet green building
7standards of the Capital Development Board and its Green
8Building Advisory Committee. With respect to those school
9construction projects for which a school district applies for
10a grant on or after July 1, 2009, the school construction
11project must receive silver certification from the United
12States Green Building Council's Leadership in Energy and
13Environmental Design Green Building Rating System unless all
14of the following are met:
15        (1) (blank); the application submitted can be
16    categorized as a capital need prioritized under item (1)
17    of Section 5-30 of this Law;
18        (2) (blank); the renovation or replacement school
19    construction project is less than 40% replacement cost, or
20    the project has been granted a waiver by the Capital
21    Development Board in consultation with the State Board of
22    Education in accordance with rules promulgated pursuant to
23    this Law;
24        (3) the school construction project is located in a
25    county with a population of more than 38,000 and less than
26    39,000 that borders the Mississippi River with a

1    population of more than 33,000 and less than 34,000,
2    according to the 2010 decennial census;
3        (4) the school district for which the school
4    construction grant will be issued has no more than 500
5    1,100 students, with the relevant school facility housing
6    no more than 150 700 students;
7        (5) the facilities for which the school construction
8    grant will be used have been in use as of August 2019
9    condemned as of July 23, 2012; and
10        (6) the application for the school construction grant
11    has been approved prior to the effective date of this
12    amendatory Act of the 102nd 98th General Assembly.

14    Section 99. Effective date. This Act takes effect upon
15becoming law.".
