Amends the Sale of Tobacco to Minors Act to impose a
civil penalty in the amount of $300 for a first violation of
the Act, $500 for a second violation, and $1,000 for a third
or subsequent violation. Provides that civil penalties shall
be collected by the State's Attorney of the county in which
the violation occurred in a civil action.

1 AN ACT to amend the Sale of Tobacco to Minors Act by
2 adding Section 3.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Sale of Tobacco to Minors Act is amended
6 by adding Section 3 as follows:
7 (720 ILCS 675/3 new)
8 Sec. 3. Civil penalty. In addition to any other penalty
9 provided under this Act, a person who violates any provision
10 of this Act shall be liable for a civil penalty in the amount
11 of $300 for a first violation, $500 for a second violation,
12 and $1,000 for a third or subsequent violation. Penalties
13 under this Section shall be enforced by the State's Attorney
14 of the county in which the violation occurred by bringing a
15 civil action in circuit court. Penalties collected under
16 this Section shall be paid to the circuit clerk who shall
17 retain 10% of the penalty to cover the costs of the clerk
18 related to collection of the penalty and shall distribute the
19 remainder to the State's Attorney of the county in which the
20 violation occurred.
