65 ILCS 5/11-80-14.7 new
Amends the Illinois Municipal Code. Provides that the
corporate authorities of a municipality shall have a
proprietary right to include a rental charge based on the
value of the property the utility company is using in the
fees the municipality charges the utility company. Provides
that a municipality shall have the power to determine which
entities may use the public way for permanent installations.

1 AN ACT to amend the Illinois Municipal Code by adding
2 Section 11-80-14.7.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Municipal Code is amended by
6 adding Section 11-80-14.7 as follows:
7 (65 ILCS 5/11-80-14.7 new)
8 Sec. 11-80-14.7. Rental charge; utility company. The
9 corporate authorities of a municipality shall have a
10 proprietary right to include a rental charge based on the
11 value of the property the utility company is using in the
12 fees the municipality charges the utility company. A
13 municipality shall have the power to determine which entities
14 may use the public way for permanent installations.
