          Amends  the  Workers'  Compensation  Act   and   Workers'
      Occupational  Diseases Act.  Provides that any person who, by
      false  statement,   willful   misrepresentation,   or   other
      fraudulent  device, obtains or attempts to obtain any payment
      or benefit to which the person is not entitled or  delays  or
      denies or attempts to delay or deny any payment or benefit to
      which a claimant is entitled, is guilty of a Class 4 felony.

 1        AN  ACT  to  amend  the  Workers'  Compensation  Act  and
 2    Workers'  Occupational  Diseases Act in relation to penalties
 3    for certain conduct.
 4        Be it enacted by the People of  the  State  of  Illinois,
 5    represented in the General Assembly:
 6        Section  5.  The  Workers' Compensation Act is amended by
 7    changing Section 26 and adding Section 26.1 as follows:

 9        Sec. 26.  Except as otherwise provided in this  Act,  any
10    wilful  neglect, refusal or failure to do the things required
11    to be done by any section, clause or provision of  this  Act,
12    on the part of the persons herein required to do them, or any
13    violation of any of the provisions or requirements hereof, or
14    any  attempt to obstruct or interfere with any court officer,
15    or any other person charged with the duty of administering or
16    enforcing this Act, is a petty offense.
17        The Attorney General and the  State's  Attorney  of  each
18    county,  upon the request of the Industrial Commission, shall
19    enforce any penalties set forth in this Act.

22        Sec. 26.1.  Fraud.  A person  is  guilty  of  a  Class  4
23    felony if he or she, by means of any false statement, willful
24    misrepresentation,  or  other  fraudulent device, either: (i)
25    obtains or attempts to obtain any payment  or  benefit  under
26    this  Act  to which he or she is not entitled; or (ii) delays
27    or denies or attempts to delay or deny any payment or benefit
28    to which a claimant is entitled.
29        Section 10.  The Workers' Occupational  Diseases  Act  is

 1    amended  by  changing  Section  20 and adding Section 20.1 as
 2    follows:

 4        Sec. 20. Except as otherwise provided in  this  Act,  any
