      105 ILCS 5/34-18.17 new
          Amends the School Code.  Provides for the creation by the
      Chicago Board of Education of  a  Task  Force  on  Harassment
      Suppression  to  receive and investigate charges of, and take
      other related action with respect to, harassing and  punitive
      action  taken  by  school officials or other school employees
      against local school council  members  or  members  of  their
      families.  Effective immediately.

 1        AN  ACT  to  amend  the  School  Code  by  adding Section
 2    34-18.17.
 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:
 5        Section  5.  The School Code is amended by adding Section
 6    34-18.17 as follows:
 7        (105 ILCS 5/34-18.17 new)
 8        Sec. 34-18.17.  Task Force on Harassment Suppression.   A
 9    Standing  Task  Force  on  Harassment  Suppression  shall  be
10    created as provided in this Section.  The Task Force shall be
11    composed  of  13 members, 3 of whom shall be appointed by the
12    Governor, 2 by the Mayor, 2 by the board of education, and  6
13    by  registered  education  reform groups, each to serve for a
14    minimum term of 2 years, or for a longer term at the pleasure
15    of  the  appointing  authority.   The  Task  Force  shall  be
16    composed of community representatives, representatives of the
17    business and professional  community,  local  school  council
18    members, school officials, and representatives from civic and
19    religious  organizations;  provided,  that  of  the 6 members
20    appointed by registered education reform groups, 2  shall  be
21    parent members of local school councils, 2 shall be community
22    resident  members  of  local  school councils, and 2 shall be
23    teacher members of local school  councils.   The  Task  Force
24    shall  be  responsible   for  acting  to protect local school
25    council  members  and  their  families  from  harassing   and
26    punitive  measures of school officials and other employees of
27    the  Chicago  public  school  system  that  are  designed  to
28    interfere with the ability of local school council members to
29    fulfill their responsibilities in that office.
30        In the excercise of its  powers  and  duties  under  this
31    Section   the   Task  Force  is  authorized  to  receive  and

 1    investigate charges of harassment or punitive  measures  that
 2    are  directed  against  local school council members and that
 3    are not taken in the best interests of an  attendance  center
 4    or the pupils of an attendance center.
 5        If the Task Force after investigation and the opportunity
 6    for  a  public  hearing  determines that a school official or
 7    other employee  of  the  Chicago  public  school  system  has
 8    engaged  in harassing or punitive conduct as provided in this
 9    Section, the Task Force shall refer the matter to the general
10    superintendent of schools for such further action,  including
11    but  not limited to the filing of a motion containing written
12    charges  and  specifications  under  Section  34-85,  as  the
13    general superintendent of schools deems appropriate.  If  the
14    general  superintendent  of  schools  determines that written
15    charges and specifications should not be filed under  Section
16    34-85,  the  general  superintendent of schools shall provide
17    written reasons for that determination to both the Task Force
18    and the board of education.
19        The board of education shall provide the Task Force  with
20    the  use  of such facilities and such staff assistance as are
21    reasonably required for the performance by the Task Force  of
22    its responsibilities.
23        The  Task  Force  shall  organize itself, select from its
24    number a chairperson and such  other  officers  as  it  deems
25    necessary,  and  establish the dates of its regular meetings.
26    Special meetings may be held at the call of  the  chairperson
27    or a majority of the members of the Task Force.
28        Section  99.  Effective date.  This Act takes effect upon
29    becoming law.
