20 ILCS 3120/4 from Ch. 127, par. 3504
Amends the Asbestos Abatement Authority Act. Provides
that amounts recovered by the Attorney General's Asbestos
Litigation Division for asbestos abatement, excluding
attorney's fees and litigation costs, paid for from the Road
Fund shall be deposited into the Road Fund (now all amounts
recovered, excluding attorney's fees and litigation costs,
are deposited into the Asbestos Abatement Fund). Effective
immediately.

1 AN ACT to amend the Asbestos Abatement Authority Act by
2 changing Section 4.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Asbestos Abatement Authority Act is
6 amended by changing Section 4 as follows:
7 (20 ILCS 3120/4) (from Ch. 127, par. 3504)
8 Sec. 4. Asbestos Litigation Division. There is created
9 within the office of the Attorney General an Asbestos
10 Litigation Division. The Division, under the supervision and
11 the direction of the Attorney General, shall investigate and
12 initiate legal proceedings necessary to ensure maximum
13 recovery of asbestos abatement costs for all State entities
14 of this State. All amounts recovered by the Division,
15 including those awarded for asbestos abatement and attorney's
16 fees, shall be deposited in the Asbestos Abatement Fund in
17 the State Treasury, except that amounts recovered by the
18 Division for asbestos abatement, not including attorney's
19 fees and litigation costs, paid for from the Road Fund shall
20 be deposited into the Road Fund.

22 Section 99. Effective date. This Act takes effect upon
23 becoming law.
