      65 ILCS 5/8-3-4           from Ch. 24, par. 8-3-4
          Amends the  Illinois  Municipal  Code.   Makes  technical
      changes  in  the Section concerning the levy of a tax for the
      payment of a particular debt.

 1        AN ACT to amend the Illinois Municipal Code  by  changing
 2    Section 8-3-4.
 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:
 5        Section 5.  The Illinois Municipal  Code  is  amended  by
 6    changing Section 8-3-4 as follows:
 7        (65 ILCS 5/8-3-4) (from Ch. 24, par. 8-3-4)
 8        Sec. 8-3-4. Whenever a municipality is required to levy a
 9    tax  for  the payment of a particular debt, appropriation, or
10    liability of the municipality, the tax for that purpose shall
11    be included in the  total  amount  levied  by  the  corporate
12    authorities, and certified to the county clerk as provided in
13    Section  8-3-1.  However, if a municipality has funds arising
14    from any source whatsoever, including allocations received or
15    to be  received  under  the  Motor  Fuel  Tax  Law  that,  as
16    heretofore  and  hereafter amended which may lawfully be used
17    for the retirement of a particular  debt,  appropriation,  or
18    liability  of  the  municipality,  or the payment of the next
19    maturing installment thereof, then  if  the  municipality  by
20    resolution directs the application of those such funds to the
21    payment  of  the particular debt, appropriation, or liability
22    or next maturing installment thereof, it  shall  certify  the
23    such  resolution  to  the county clerk as provided in Section
24    8-3-1. The county clerk shall abate the levy for the  payment
25    of  the  particular  debt, appropriation, or liability or the
26    next maturing installment thereof to the extent of the  funds
27    so  certified  as  available  for such payment. The corporate
28    authorities shall determine, in  the  ordinance  making  that
29    levy,  what  proportion of that total amount shall be applied
30    to the payment of  the  particular  debt,  appropriation,  or
31    liability.  The  municipal  treasurer  shall  set  apart that

 1    proportion of the tax, collected and paid  to  him,  for  the
 2    payment  of the particular debt, appropriation, or liability,
 3    and shall not disburse that proportion of  the  tax  for  any
 4    other purpose until the debt, appropriation, or liability has
 5    been discharged.
