          Amends the Partnership for Long-Term Care Act.   Makes  a
      stylistic change in provisions regarding agency powers.

 1        AN ACT to amend the Partnership for Long-Term Care Act by
 2    changing Section 45.
 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:
 5        Section 5.  The Partnership for  Long-Term  Care  Act  is
 6    amended by changing Section 45 as follows:
 7        (320 ILCS 35/45) (from Ch. 23, par. 6801-45)
 8        Sec. 45.  Agency powers; rules regulations.
 9        (a)  The  Departments  shall  adopt  rules regulations to
10    implement  this  Act,  including,  but  not  limited  to  the
11    following:
12             (1)  The population and age groups that are eligible
13        to participate in the program.
14             (2)  The minimum level of long-term  care  insurance
15        that  must  be  purchased  to  meet  the  requirement  of
16        subsection (b) of Section 20 of this Act.
17             (3)  The   amount  and  types  of  services  that  a
18        long-term care insurance policy that  includes  long-term
19        care  services  must  cover  to  meet the requirements of
20        Section 30 of this Act.
21             (4)  Which coordinating entities are  designated  or
22        approved   to  deliver  individual  assessment  and  case
23        management services to individuals in a community setting
24        as required by subdivision (b)(2) of Section 25  of  this
25        Act.
26             (5)  The  disability  criteria  for  eligibility for
27        long-term care benefits as required by subdivision (b)(3)
28        of Section 25 of this Act.
29             (6)  The  specific  eligibility   requirements   for
30        receipt  of  the  Medicaid  benefits  provided for by the
31        program, and the Medicaid benefits for which participants

 1        in the program shall be eligible.
 2        (b)  The Departments shall also adopt  rules  regulations
 3    to  implement  this Act, including, but not limited to, rules
 4    regulations which establish the following:
 5             (1)  The  specific  eligibility   requirements   for
 6        in-home supportive service benefits.
 7             (2)  Those  in-home  supportive service benefits for
 8        which participants in the programs shall be eligible.
