      30 ILCS 775/15
          Amends the Excellence in Academic Medicine Act.  Includes
      in  the  definition  of   "Qualified   Non-Chicago   Medicare
      Metropolitan   Statistical   Area   academic  medical  center
      hospital" the primary teaching hospital for the University of
      Illinois   School   of   Medicine   at   Urbana.    Effective
      immediately.

 1        AN ACT to amend the  Family  Practice  Residency  Act  by
 2    changing Section 10.
 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:
 5        Section 5.  The Family Practice Residency Act is  amended
 6    by changing Section 10 as follows:
 7        (110 ILCS 935/10) (from Ch. 144, par. 1460)
 8        Sec.  10.  Scholarship recipients who fail to fulfill the
 9    obligation described in subsection (d)  of  Section  3.07  of
10    this  Act  shall pay to the Department a sum equal to 3 times
11    the amount of the annual scholarship grant for each year  the
12    recipient  fails  to  fulfill such obligation.  A scholarship
13    recipient who fails to fulfill the  obligation  described  in
14    subsection  (d)  of  Section 3.07 shall have 30 days from the
15    date on which that failure begins in which to  enter  into  a
16    contract  with  the  Department that sets forth the manner in
17    which that sum is required to be paid.  If  the  contract  is
18    not entered into within that 30 day period or if the contract
19    is entered into but the required payments are not made in the
20    amounts  and  at  the  times  provided  in  the contract, the
21    scholarship recipient also shall be required to  pay  to  the
22    Department interest at the rate of 9% per annum on the amount
23    of that sum remaining due and unpaid.
24        Until  January  1, 2000 the Director may waive payment of
25    the sum otherwise due under this Section in  the  case  of  a
26    scholarship  recipient who (i) practices psychiatry full-time
27    in a Designated Shortage Area one year for each  year  he  or
28    she  was  a scholarship recipient, but does not practice as a
29    primary care physician, and (ii) has met or meets  all  other
30    qualifications  for receipt of the scholarship as provided in
31    this Act.

 1        The amounts paid to the  Department  under  this  Section
 2    shall be deposited into the Community Health Center Care Fund
 3    and  shall  be  used  by  the Department to improve access to
 4    primary  health  care  services  as  authorized  by   Section
 5    55.53(a) of the Civil Administrative Code of Illinois.
 6        The  Department  may transfer to the Illinois Development
 7    Finance  Authority,  into  an  account  outside   the   State
 8    treasury,  moneys in the Community Health Center Care Fund as
 9    needed, but not to exceed an amount established, by rule,  by
10    the  Department  to establish a reserve or credit enhancement
11    escrow account to support a financing program or  a  loan  or
12    equipment  leasing  program  to provide moneys to support the
13    purposes of Section 55.53(a) of the Civil Administrative Code
14    of Illinois. The disposition of moneys at the  conclusion  of
15    any  financing program under this Section shall be determined
16    by an interagency agreement.

18        Section 99.  Effective date.  This Act takes effect  upon
19    becoming law.
