      730 ILCS 5/5-5-2          from Ch. 38, par. 1005-5-2
          Amends  the   Unified   Code   of   Corrections.    Makes
      grammatical  changes in Section relating to the penalties for
      unclassified offenses.

 1        AN ACT to  amend  the  Unified  Code  of  Corrections  by
 2    changing Section 5-5-2.
 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:
 5        Section 5.  The Unified Code of Corrections is amended by
 6    changing Section 5-5-2 as follows:
 7        (730 ILCS 5/5-5-2) (from Ch. 38, par. 1005-5-2)
 8        Sec. 5-5-2. Unclassified Offenses.)  (a)  The  particular
 9    classification  of  each  felony  is  specified  in  the  law
10    defining  the  felony.   Any  unclassified  offense  which is
11    declared by law to be a felony or which provides  a  sentence
12    to  a term of imprisonment for one year or more is shall be a
13    Class 4 felony.
14        (b)  The particular classification of each misdemeanor is
15    specified in the law or ordinance defining the misdemeanor.
16        (1)  Any offense  not  so  classified  which  provides  a
17    sentence  to a term of imprisonment of less than one year but
18    in excess of 6 months is shall be a Class A misdemeanor.
19        (2)  Any offense  not  so  classified  which  provides  a
20    sentence to a term of imprisonment of 6 months or less but in
21    excess of 30 days is shall be a Class B misdemeanor.
22        (3)  Any  offense  not  so  classified  which  provides a
23    sentence to a term of imprisonment of  30  days  or  less  is
24    shall be a Class C misdemeanor.
25        (c)  Any  unclassified offense which does not provide for
26    a sentence of imprisonment is shall be a petty offense  or  a
27    business offense.
