      605 ILCS 10/40 new
          Amends the Illinois Highway Code  and  the  Toll  Highway
      Act.   Abolishes the Illinois State Toll Highway Authority on
      January 1, 1998.  Provides that at  that  time,  all  duties,
      obligations,  property,  assets,  and  powers,  including the
      power to issue bonds provided that  they  are  repaid  on  or
      before  December  31,  2020,  shall  be  transferred  to  the
      Illinois  Department  of  Transportation.   Provides that the
      Department shall take over the management  and  operation  of
      the  existing  toll  highways in the State. Provides that all
      outstanding debts of the Authority shall be paid in  full  on
      or  before  December  31,  2020,  and  at  that time all toll
      highways shall become a part of the State highway system  and
      be  maintained and operated free of tolls.  Provides that all
      employees of the Authority on December 31, 1997 shall  become
      employees   of   the   Department,   subject   to  layoff  or
      reorganization by the Department.  Provides for  distribution
      of  the  assets  of  the  Authority's  employee pension plan.

 1        AN  ACT  concerning  the  Illinois  State  Toll   Highway
 2    Authority.
 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:
 5        Section 5.  The  Illinois  Highway  Code  is  amended  by
 6    adding Section 4-219 as follows:
 7        (605 ILCS  5/4-219 new)
 8        Sec. 4-219.  Transfer of property from the Illinois State
 9    Toll  Highway Authority.  On or before December 31, 1997, the
10    Illinois State Toll Highway Authority shall transfer  all  of
11    its  records, documents, property, and assets to the Illinois
12    Department of Transportation.  The Department  shall  succeed
13    to  all rights and interests of the Authority at the close of
14    the Authority's business on December 31, 1997, including  any
15    right  or  interest  relating  to any cause of action then in
16    existence.  The Department shall  take  over  management  and
17    operation  of  the  existing  toll  highways in the State and
18    shall be authorized to establish tolls,  rates,  and  charges
19    for  use  of the highways and pledge the income from the toll
20    highways, after  maintenance  and  operation  costs,  to  the
21    outstanding indebtedness incurred by the Authority.
22        Section  10.  The  Toll  Highway Act is amended by adding
23    Section 40 as follows:

25        Sec. 40.  Abolishing the Authority.
26        (a)  It is the intention and purpose of  this  amendatory
27    Act  of  1997  that  the  Toll  Highway  Authority  shall  be
28    abolished and the terms of its chairman and directors holding
29    office  shall  expire  on January 1, 1998.  At that time, the

 1    management and operation of the existing toll highways  shall
 2    be  transferred to the Illinois Department of Transportation.
 3    On or before December 31, 2020, all outstanding  indebtedness
 4    of  the  Authority  shall have been paid in full and the toll
 5    highways shall become a part of the system of State  highways
 6    of Illinois and be maintained and operated free of tolls.
 7        (b)  All   duties  and  obligations,  together  with  all
 8    records, documents, property, and  assets  of  the  Authority
 9    shall  be transferred to the Illinois Department at the close
10    of business on December 31, 1997.
11        (c)  All powers of the Authority, including the power  to
12    issue  bonds  provided  that  they  are  repaid  on or before
13    December 31, 2020,  shall  be  transferred  to  the  Illinois
14    Department  of  Transportation  at  the  close of business on
15    December 31, 1997.
16        (d)  All employees of the Authority on December 31,  1997
17    shall   become   employees  of  the  Illinois  Department  of
18    Transportation, subject to lay off or reorganization  by  the
19    Department.
20        (e)  On  or before December 31, 1997, the Authority shall
21    terminate the Illinois State Toll Highway  Authority  Defined
22    Benefit Pension Plan and distribute the assets of the plan in
23    accordance   with  the  terms  of  the  plan  and  any  other
24    requirements imposed by State or federal law.
25        Section 99.  Effective date.  This Act takes effect  upon
26    becoming law.
