Amends the Illinois Vehicle Code to raise the maximum
speed limit outside an urban area to 65 miles per hour for
any second division vehicle designed or used for the carrying
of a gross weight of 8,001 pounds or more, bus (on highways
under the jurisdiction of the Department of Transportation or
the Illinois State Toll Highway Authority), house car,
camper, private living coach, recreational vehicle, and
vehicle towing any other vehicle. Provides that a first
division vehicle or second division vehicle designed or used
for the carrying of a gross weight of 8,000 pounds or less
may exceed the posted speed limit outside an urban district
by 5 miles per hour to overtake and pass a second division
vehicle designed or used for the carrying of a gross weight
of 8,001 pounds or more. Effective immediately.

1 AN ACT to amend the Illinois Vehicle Code by changing
2 Section 11-601.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Vehicle Code is amended by
6 changing Section 11-601 as follows:
7 (625 ILCS 5/11-601) (from Ch. 95 1/2, par. 11-601)
8 Sec. 11-601. General speed restrictions.
9 (a) No vehicle may be driven upon any highway of this
10 State at a speed which is greater than is reasonable and
11 proper with regard to traffic conditions and the use of the
12 highway, or endangers the safety of any person or property.
13 The fact that the speed of a vehicle does not exceed the
14 applicable maximum speed limit does not relieve the driver
15 from the duty to decrease speed when approaching and crossing
16 an intersection, approaching and going around a curve, when
17 approaching a hill crest, when traveling upon any narrow or
18 winding roadway, or when special hazard exists with respect
19 to pedestrians or other traffic or by reason of weather or
20 highway conditions. Speed must be decreased as may be
21 necessary to avoid colliding with any person or vehicle on or
22 entering the highway in compliance with legal requirements
23 and the duty of all persons to use due care.
24 (b) No person may drive a vehicle upon any highway of
25 this State at a speed which is greater than the applicable
26 statutory maximum speed limit established by paragraphs (c),
27 (d), (e), (f) or (g) of this Section, by Section 11-605 or
28 by a regulation or ordinance made under this Chapter.
29 (c) Unless some other speed restriction is established
30 under this Chapter, the maximum speed limit in an urban
31 district for all vehicles is:

1 1. 30 miles per hour; and
2 2. 15 miles per hour in an alley.
3 (d) Unless some other speed restriction is established
4 under this Chapter, the maximum speed limit outside an urban
5 district for any vehicle of the first division or a second
6 division vehicle designed or used for the carrying of a gross
7 weight of 8,000 pounds or less (including the weight of the
8 vehicle and maximum load) is (1) 65 miles per hour (i) for
9 all highways under the jurisdiction of the Illinois State
10 Toll Highway Authority and (ii) for all or part of highways
11 that are designated by the Department, have at least 4 lanes
12 of traffic, and have a separation between the roadways moving
13 in opposite directions and (2) 55 miles per hour for all
14 other highways, roads, and streets. However, a vehicle of the
15 first division or a second division vehicle designed or used
16 for the carrying of a gross weight of 8,000 pounds or less
17 (including the weight of the vehicle and maximum load) may
18 exceed the maximum posted speed limit outside an urban
19 district by 5 miles per hour in order to overtake and pass a
20 second division vehicle designed or used for the carrying of
21 a gross weight of 8,001 pounds or more (including the weight
22 of the vehicle and maximum load) proceeding in the same
23 direction, overtaking and passing to the left side of the
24 roadway and in accordance with Article VII of this Chapter,
25 until the vehicle of the first division or a second division
26 vehicle designed or used for the carrying of a gross weight
27 of 8,000 pounds or less (including the weight of the vehicle
28 and maximum load) is safely clear of the overtaken second
29 division vehicle designed or used for the carrying of a gross
30 weight of 8,001 pounds or more (including the weight of the
31 vehicle and maximum load) and is able to again drive to the
32 right side of the roadway.
33 (e) (Blank). Unless some lesser speed restriction is
34 established under this Chapter, the maximum speed limit

1 outside an urban district for a second division vehicle
2 designed or used for the carrying of a gross weight of 8,001
3 pounds or more (including the weight of the vehicle and
4 maximum load) is 55 miles per hour.
5 (f) Unless some other speed restriction is established
6 under this Chapter, the maximum speed limit outside an urban
7 district for a bus is:
8 1. 65 miles per hour upon any highway which has at
9 least 4 lanes of traffic and of which the roadways for
10 traffic moving in opposite directions are separated by a
11 strip of ground which is not surfaced or suitable for
12 vehicular traffic, except that the maximum speed limit
13 for a bus on all highways, roads, or streets not under
14 the jurisdiction of the Department or the Illinois State
15 Toll Highway Authority is 55 miles per hour; and
16 2. 65 60 miles per hour on any other highway,
17 except that the maximum speed limit for a bus on all
18 highways, roads, or streets not under the jurisdiction of
19 the Department or the Illinois State Toll Highway
20 Authority is 55 miles per hour.
21 (g) Unless some other speed restriction is established
22 under this Chapter, the maximum speed limit outside an urban
23 district for a house car, camper, private living coach,
24 vehicles licensed as recreational vehicles, and any vehicle
25 towing any other vehicle is 65 55 miles per hour or the
26 posted speed limit, whichever is less.

28 Section 99. Effective date. This Act takes effect upon
29 becoming law.
