      30 ILCS 580/3.5 new
          Amends the Drug Free Workplace Act.  Requires contractors
      who are awarded contracts funded  in  whole  or  in  part  by
      revenue  collected  under  the Motor Fuel Tax Law to maintain
      records establishing that each employee  performing  work  in
      connection  with each such project shall have been tested for
      drugs within not more than 6 months before commencing work on
      the project.  Requires the contractor to maintain the records
      in confidence.

 1        AN ACT to amend the Drug Free  Workplace  Act  by  adding
 2    Section 3.5.
 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:
 5        Section 5.  The Drug Free Workplace  Act  is  amended  by
 6    adding Section 3.5 as follows:
 7        (30 ILCS 580/3.5 new)
 8        Sec.  3.5.  Projects  funded  with  Motor  Fuel  Tax  Law
 9    revenue.   Contractors  who  are  awarded contracts funded in
10    whole or in part by revenue collected under  the  Motor  Fuel
11    Tax  Law  shall  be required to maintain records establishing
12    that each employee performing work in  connection  with  each
13    project  funded  with  revenue collected under the Motor Fuel
14    Tax Law shall have been tested for drugs,  as  that  term  is
15    defined  in  this  Act,  within not more than 6 months before
16    commencing  work  on  the  project.   The  records  shall  be
17    maintained in confidence by the contractor and shall  not  be
18    disclosed  to  any  individual  or  entity not having a valid
19    reason for  such  information  except  that  the  contracting
20    entity  shall have the right to inspect the records to verify
21    the contractor's compliance with this Act.
