 1                    AMENDMENT TO SENATE BILL 1561
 2        AMENDMENT NO.     .  Amend Senate Bill 1561, AS  AMENDED,
 3    by  inserting  immediately  below  the  end  of Section 5 the
 4    following:
 5        "Section 7.  The Public Community College Act is  amended
 6    by changing Section 3B-3 as follows:
 7        (110 ILCS 805/3B-3) (from Ch. 122, par. 103B-3)
 8        Sec.  3B-3. Dismissal of Non-tenure Faculty Member. Every
 9    Board shall provide by rule or contract for  a  procedure  to
10    evaluate  the  performance  and  qualifications of non-tenure
11    faculty members. If  the  implementation  of  such  procedure
12    results  in a decision to dismiss a non-tenure faculty member
13    or if the Board decides to dismiss the faculty member for any
14    other reason for the ensuing school year or term,  the  Board
15    shall  give  notice  thereof  to the faculty member not later
16    than 60 days before the end of the school year or term.   The
17    specific  reasons for the dismissal shall be confidential but
18    shall be issued to the faculty member teacher  upon  request.
19    If  the  Board  fails  to  give  such notice, within the time
20    period, the faculty member shall be deemed reemployed for the
21    ensuing school year. If the Board fails to give  such  notice
22    within the time provided during the third year, or during the

 1    fourth  year in the case of a one year extension, the faculty
 2    member shall enter upon tenure during the ensuing school year
 3    or term.
 4        The changes made by  this  amendatory  Act  of  1998  are
 5    declaratory of existing law.
