LRB9001835WHmg LRB9001835WHmg 1 AN ACT concerning rent control. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 1. Short title. This Act may be cited as the Rent 5 Control Preemption Act. 6 Section 5. Rent control prohibited. 7 (a) A unit of local government, as defined in Section 1 8 of Article VII of the Illinois Constitution, shall not enact, 9 maintain, or enforce an ordinance or resolution that would 10 have the effect of controlling the amount of rent charged for 11 leasing private residential or commercial property. 12 (b) This Act does not impair the right of a unit of 13 local government to manage and control residential property 14 in which the unit of local government has a property 15 interest. 16 Section 10. Home rule preemption. A home rule unit may 17 not regulate or control the amount of rent charged for 18 leasing private residential or commercial property. This 19 Section is a denial and limitation of home rule powers and 20 functions under subsection (g) of Section 6 or Article VII of 21 the Illinois Constitution. 22 Section 99. Effective date. This Act takes effect upon 23 becoming law.
